Let the matter be decided by Apex.
by chanakya maurya on Aug 06, 2008 12:55 PM  Permalink

If the HC verdict is upheld, well, it is the supreme judiciary saying so.

In any case, the Apex itself must take up the cudgells and pull the case into its fold for a verdict under PIL provisions, and if necessary, direct the authorities concerned to work out some legislations so that such cases could be dealt with with due care, caution and control.

No judiciary in the world will be judicious to impose on parents a life time burden.

However, there must be some sort of legislation in place to deal with such cases rather than leaving the matter to the whims of the judiciary.

As they say, the Law is an Ass.

And we just cant be passive receipients of that ass's undue kicks !!!!

HC have got it all wrong !!!!
by Vinayak Gadekar on Aug 05, 2008 07:19 PM  Permalink

Call it Euthanesia or whatever but the Mehta's should have been allowed to abort. Imagine the plight of the 'unborn' when he/she will be born....Why is High Court hell-bent on giving more misery to the Mehtas and the unborn child till he/she lives in this world, especially since they now know the condition of the unborn ?

Is the Indian state/ High Court taking responsibility for providing all medical help and covering of expenses, as is the case in the European countries, during the child's life ?

It is a very irresponsible judgement passed by the High Court without any accountability. The judiciary time and again have passed judgements without understanding the spirit behind the applications.

So they have themselves reduced their role only as being 'enforcers' of law and not the guardians of the law. It is the immaturity of our society that we are not able to distinguish between a genuine and a non-genuine context.

Legalised Abortion
by Akshaya Nayak on Aug 05, 2008 08:01 AM  Permalink

Abortion, the term seems to be very much pronounced for killing of any foetus, but it does not mean that, for any strong and firm reason, the Abortion is legalised, whether in case of any rape victim/uncertaintity in pregnancy/if both the parents are unaware of knowledge of pregnancy etc.But this case the matter is somehow looks different and the Hon'ble Court has set aside the reason, which mourns the parents, further the Abortion now-a-days is a best weapon for the unmarried youngsters which is a problem for any individual to believe the real aspect if any one faced like this particular aspect. So, for my opinion, this should not be used as vulernable method which the youngster follows.

abortion !
by Guest on Aug 05, 2008 06:53 AM  Permalink

it is sad to see, couples killing their own children just because of some defects which were detected on ultrasound. If this machine was invented 50 yrs ago i can assure you that most of us would not be alive today. It is God who gives life. We are not born by chance, children are a gift of God. If a child has a defect, then God wants us to endure it and love the child and give our complete love to the child.

Evidence from Williams Obstetrics, 21st edition, page no. 675.. 4th paragraph.........
…………….. Brucato and co-workers (2003) reviewed 1825 cases of congenital heart block from 38 studies. They reported that in utero diagnosis is associated with a much poorer prognosis and a higher risk of late-onset dilated cardiomyopathy than when the diagnosis is made in childhood.

Please forward my opinion and these evidences to Mr. and Mrs. Niketa, their Gynaecologist and their lawyer if any one knew thier email IDs..

Evidence from Ultrasonography in Obstetrics and Gynaecology by Peter W. Callen, Professor of Radiology, Obstetrics, Gynaecology, and Reproductive Sciences, University of California School of Medicine, San Francisco, California, USA 4th edition.
…..Page no. 414….3rd paragraph… Cardiac defects coupled with complete atrioventricular block were present in eight fetuses; in this group, there were seven prenatal or neonatal deaths. The prognosis for fetal survival appears to be poor in the presence of structural abnormalities coupled with atrioventricular regurgitation, complete heart block, or fetal hydrops. ..contd..

right to abortion 5
by naveen on Aug 05, 2008 05:37 AM  Permalink

Q. What if I am under 16?
Ans: Any young person, regardless of age, can give valid consent to medical treatment providing she is considered to be legally competent – that is, able to understand a health professional’s advice and the risks and benefits of what is being offered. All very young women are encouraged to involve their parents or another supportive adult. If you choose not to do this, doctors can offer you an abortion if they are confident that you can give valid consent and that it is in your best interests.
Q. How safe is abortion?
Ans : For most women an abortion is safer than carrying a pregnancy and having a baby. All medical and surgical procedures have risks, but the earlier in pregnancy you have an abortion, the safer it is. Your doctor or nurse should tell you about risks and complications that relate to the specific abortion procedure(s) being offered to you. If you have special concerns about certain kinds of risk, let your healthcare team know so that they can tell you more.
