If the HC verdict is upheld, well, it is the supreme judiciary saying so.
In any case, the Apex itself must take up the cudgells and pull the case into its fold for a verdict under PIL provisions, and if necessary, direct the authorities concerned to work out some legislations so that such cases could be dealt with with due care, caution and control.
No judiciary in the world will be judicious to impose on parents a life time burden.
However, there must be some sort of legislation in place to deal with such cases rather than leaving the matter to the whims of the judiciary.
As they say, the Law is an Ass.
And we just cant be passive receipients of that ass's undue kicks !!!!
