There should be no punishment to Drunk Drivers. Infact when a person is drunk, he slightly out of mind and in this he should be instead given some liberty in laws as any deed done during he/she was drunk was not purposely, it just happened out of mistake. Another reason, its not matter of rich or poor,.. but street is not a place to sleep. Any kind of accident or anything can happen if you sleep openly in footpaths or streets at night. Even a mad dog can suddenly bite you. Who is responsible for that ? If anyone speaks about poverty(poor people with no house) in this regard and then my comment is i'm not responsible for it. Government should look into it that footpath as the name implies should be used only for walking and not sleeping. Moreover just because the people sleeping there were poor, it does not mean you always have to point like Hindi movies that Poor people are good and Rich is always Bad. The vehicle owners pay road tax and not the padestrians or the people who sleep there at night.
The Dwellers should file a Murder case against these "Spoiled Brats", one can imagine, what their parents are !

In this case, since they were drunk, did not have the control, they killed these dwellers. If the axle was broken, one can find it from the marks on the road !
Where law enforcement is lax there would be no justice. Drunken driving is a crime and must legitimately be punished by the State.Ideally, the driving licence should be cancelled, the driver made to pay the compensation, and additionally jailed. We may have very harsh laws but if they are breached regularly without punishment then this is worse than having no laws at all. Our courts are monuments to tardy implementation of the law. This makes the law enforcement lax and the cycle of law breaking is perpetuated. No civil society can exist with such a state of affairs and the descent into mob fury and mob justice is inevitable.
Lets face a fact.ALL drunken driving and killings thereof are to do with the rich and affluent.if an ORDINARY person had got into trouble then neither the media NOR the person/persons would come into the lime light.They may rot in jail ofcourse.And as we ALL know,the rich will kill and get away with it as something inconsequential.The case of Salman and the Nanda incident are TWO where the guilty ( sorry NOT guilty till proven)are still fresh in our minds, just like the killings of J.Lal, Matto et al.Similarly the current case will be forgotten,with TIME being the biggest tranquiliser.So the ONLY persons who SHOULD be hauled up are the investigating agencies,who tend to MIX up facts with political pressures, and political pressures with money, and finally money with total acquittal of the accused.Not to forget legal eagles like Ram J, who are always available to play around with words,jurisprudence, reference histories, not to forget the persons who sit in judgement, who like Cesear will say "I wash my hands of the blood of this man".Lets have a reality show and re-enact these incidents as a "time-pass" TV presentation.
Is it prudent to delicense a driver for whom driving is a means of survival? Law also considers the motive if any behind the killing. Off course, there are those who drink for just pleasure and have no qualms for there causing any troble to others and such people should be dealt with strictly by law and society alike. Drinking by poor to get relief from their sorrows has been justified by leading media people too. Just as a periodic PUC check is it not possible to check the alcohol levels in the driver's blood too and thereby facilitate a preventive measure?
First thing is, India does not follow a uniform structure of issueing Driving Licence; every state has its own style and system. This the biggest fault resulting increased number of accidents and voilation of traffic law. The Central Govt.must structure this, simliar to issue of Passport.
Any drunk driver detained for breaking the law, his or her licence must be cancelled for 5(five ) years; fresh licence should be issued with a garuntor and surety. This should apply to all type of automobile;whether two wheeler or four.
Repeat offence should amount to 10(ten) year Ban for licence eligibility; as well vehical confistication. Unless these systmes are incorporated the number of crime will increase and enforcement agencies will have field day in bribe taking.
If they are caught... 10000/= Fine plus consficate there licence.
In the case above where he killed 7 people... Section 302 not (304 Homicide) should be put...because before drinking he was aware that he has to drive back.... even then he got so much drunk that he ran over so many people...

Result: A mother and father lost their child. Siblings lost a loving sister and the society lost a young girl who just wanted to achieve her dreams A case under Section 304 of the IPC (Culpable homicide not amounting to murder) was filed against them
Crimescene 2: Nov122006,Time 3.45 am,Venue: Carter Road,Mumbai 5 drunken youths in their Toyota Corolla, completely inebriated, ran over 10 pavement dwellers sleeping in their huts. 6 of them were crushed to death Result: Families of all dead are lost forever.who will bring back their loved ones?
There are so many crime scenes everyday. But they only remain as crime scenes as there are no strict laws against drunken driving. (This message will continue in my next post as there is word limit.)
First they should check at all signals for alcohol detection and speed detection. If someone flouts the rule he should be shown on tv as an offender. If repeated his licence should be withdrawn and not allowed to drive and car impounded and used for charity. If in an accident the culprit car should be sold off and compensation should be paid to the victim. The person should go for life to prison and his family should also be flashed on tv; thus showing how irresponsible his parents are.
