Promise is a Promise

Abu Salem would no doubt deserves death penalty for all the dastardly acts of him. However, promise is a promise. If we don't keep our word, India's words won't carry much weight in future. That is not ggod. So he should not be given death penalty. He should be given a lifer, stay in jail till death. He should not be released after customary 14 years of imprisonment.

That definitely is not commensurate with the level of his crime, but as they say, something is better than nothing. Remember this --If India had not promised, he would extrdited not he would have been a free bird with no punishment at all. So I say something is better than nothing.

Legal position regarding death penalty to Abu Salem.

My personal opinion is that CBI may put pre-condition before the court as per Article 51 (c) of the constitution which states, "the state shall endeavour to .......foster respect for international law and treaty obligations in the dealings of organised people with one another." So, the matter being closely related to the international law, the court needs to take into consideration this provision of law also. However, in the said provision the "state" shall "endeavour" but it cannot compel the court to do so. The alleged offences are "rarest of the rare cases" for which death penalty can be awarded. In such a conflicting situation result seems to be that the courts can award death penalty to the Abu Salem but the President can modify this coviction. Another issue that needs to be considered is that whether imposition of such condition for extradition by the Portugal Government is good in International Law. The Portugal Government, if tries the accused under its own jurisdiction then it has to observe its own laws but once it is extraditing the accused to a foreign country such a pre-condition becomes bad in international law due to undue-influence. I feel the guy cannot get a sentence for the simple reason that if govt. goes ahead and hangs him all the abu salems of this country will go and beach bathe in portugal as that govt. will never extradite anyone to india!!! so it would be foolish on the govt.'s part to give him death.



another way out could be that he be tried for 3 or 4 cases on him and sentenced to life which the portugese have asid should not exceed 25 yrs. very fine indeed. but the rest of the cases out of nine should be heard after the 25 yr period is completed. voila!! u have the bugger behind bars till he rots and dies in the jail! for all the innocents he has killed and all those families he has maimed and hurt he needs the worst punishment that God gives in hell. as for our dear monica who despite being a hindu is a shame on her religion. a muslim woman would never keep close ties (let alone marry) a hindu who has committed such an act on muslim people! this is the irony of our so called HINDUS.

Yes,we should stick to the pre-condition..That would do India a lot of good in future extradition cases(for the larger good of India, we really do no want such scenarios).



By the way Abu Salem can be put in a dark hole, say something like solitary confinement-thereby effectively shutting him out of civilization.

Absolutely, and it should be fast. Keeping him in the prison just gives him a chance to carry out his terror network from the jail and it is a waste of the tax payer's money. In a country like India where the money could be used on welfare schemes we cannot afford to waste money and resources on a man who has no respect for other people's lives.

He should die and he should die soon, that will be the only justice to the people killed in the bomb blasts and people killed by him and his network for money.

HANG HIM TILL DEATH And do it fast. No mercy for a dreaded terrorist like Abu Salem.

Death penalty for Abu Salem

The Indian Penal Code specifies DEATH penalty for murdering a single person.Abu Salem has caused death of about 250 Indian citizens,ruined lives of hundreds of their dependents,caused huge expenses on investigation,foreign travel etc.,harrassed Indian police authorities,enjoyed luxurious living in Europe and succeeded in dodging punishments for his crimes. Monica also most certainly provided him all wifely support in his crimes, and did not help law and justice. The Portugal law avoiding death sentence is faulty and hypocritical. Will the Portuguese courts let Abu Salem live if he proposes to murder 250 citizens of that country? Abu Salem/Monica must be punished exemplarily and publicly and quickly, without allowing our lawyers to cause any delays on any grounds whatsoever, and some routine and time-consuming procedures may even be discarded for that purpose. Let the Police and the Court/s give decisions in one or two and three straightforward, open-and-shut cases, and see that death sentence, if warranted, is executed quickly in a matter of a few weeks.

Let the new CJI and the POresident think and talk of other things than the capital punishment.

Before having any second thoughts on Abu Salem's conviction, one should remember the 250 odd families who've been effected by his deadly deeds. A person who is responsible for the killings of hundreds of people should never be spared. Where a person was given a death penalty after spending half of his life in the prison for a rape, how can this brutal murderer be spared???? While US is publicly announcing wars on nations, why should India compromise on a TERRORIST.
