Yes. He should definitely be given a death sentence. Brought under a precondition that he would not be hanged would send a wrong message to the people of India. He has committed a heinous crime taking the lives of innocent people and interrupting the system. If there is anything more than this punishment, he would deserve it.

But if we fail to take the Portugal Govt in to confidence, then in future, not only the Portugal but others may not extend any co-operation. In this case, Indian govt have to use its diplomatic skills to provide justice to all those people who have suffered losses from Salem.

When India has given a promise in the case, it should NOT ask for capital punishment. This will destroy the credibility of our brave police and intelligence men. He should be sentenced to 25 years rigorous imprisonment, but should be confined NOT in a jail anywhere near mumbai. It is best to keep him in a remote jail in say TamilNadu. There should be an annual review of his jail, where a judge should certify personally that Salem is undergoing his sentence as per law. This is part A of his sentence.

Agreements must be honored which in this case means no death penalty. But no one said he should not be life imprisonment without the possibility of parole and perhaps must be given solitary confinement. He is more danger being somewhere in France than under Indian prison control (assuming there are no corrupt officers there to help him escape).
