once convicted make a separate application to the portuguese government and get them around to your line of thinking by explainig to them the gravity of the crime of communal terrorism and of genocide of innocent civilians of pre planned organised crime.
they too will understand.
take your own time. let the convict bide his time and think of all the crimes that he committed all his life. let him repent at liesure.
let the terror of the noose be a suspense to him day in day out. and then... atlast one fine day at predawn execute him at the gallows. let him defecate at the sight of the 'altar'
If the law of the land is supreme and the justice is finally done favouring death penality for the damn Abu Salem, then India must forget "what Portugal is" and go ahead with the course of justice.
After all, that country imposing a precondition for the extradition is no great a country for such matters and India should better assert that.
The act of terrorism done by Abu Salem has no pardon. Nothing can justify innocent killings. And for such heinous crimes, death penalty is the only sentence that should be given. But one should not forget, that a commitment has been given by the government of the country. And under all circumstances, this commitment given to another country needs to be honoured by our judiciary. Because it is matter of our country's commitment given to another country. If it is not honoured, the repurcussions in international arena for our country is very evident in the long run.
He should be given death penalty & that too expeditiously....It has been 12 years since the serial blasts took place & it is high time justice prevails. Unlike the other cases in the indian legal system, this should be disposed quickly. Remember Justice Delayed is Justice Denied. Again this should not become a political issue as regards the commitment given to Portugese Govt. I suppose we can always explain to Portugal on the nature of Abu Salem's crimes & convincing them shouldn't be too difficult. Political bickering should not provide the escape route for a dreaded criminal like Salem.
Sure, he must be awarded Death Penalty. If govt dont do that there will always be fear of attacks for his release and moreover extra police personnel needs to be deployed to have an eye at him(costly affair).
The fact that Salem deserves the death penalty cannot be disputed. However, he should not be and will not be given the capital punishment because that was the main if not the only condition that allowed India to extradite him from Portugal. If the Union of India does infact award Salem the death penalty
1. It would set a bad precedent for other countries to refuse honoring of extradition treaties with India in the future.
2. It would tarnish the image of Indian law and judiciary.
Yes abu should be killed. Not only abu salem, but all the terrorists caught should be killed they should not be put behind the bars. Arresting a terrorist will give birth to hijack and kidnap dramas.
The Law must take its course without any pre-conditions. We believe in India, Law is SAME FOR EVERYONE, Nobody is special or previleged, in the eyes of Law.
If capital punishment does not exist in a country where a suspect is held, does not mean same LAW should be applicable in India. If India has given an undertaking, then was this done Lawfully - IF NOT LAWFULLY DONE, Then this group of person / party who has done - has done for its PERSONAL BENEFITS and not in the interest of the country.
The concerned person / party should be made accountable and prosecution started for CHEATING THE INDIANS for such a Henious Crime.
Such terrorists should not be interrogated also...Their acts are inexcusable...In my opinion even death penalty is a lesser punishment for such individuals who betray their motherland for the sake of money.
