The fact that Salem deserves the death penalty cannot be disputed. However, he should not be and will not be given the capital punishment because that was the main if not the only condition that allowed India to extradite him from Portugal. If the Union of India does infact award Salem the death penalty
1. It would set a bad precedent for other countries to refuse honoring of extradition treaties with India in the future.
2. It would tarnish the image of Indian law and judiciary.
