Clearly everyone needs to read this article, before taking any new offer letter. This happens to everyone, like in Bangalore companies cut Gratuity, Professional tax, but in Delhi there is no such thing.
i too am a victim of office politics and beauracacy. i am unemployed since last 6 months will any company give me work at 15k salary for back office, any advice

make sure your annual/periodic salary review and bonuses etc, totally account for the booming price rise, that every single citizen of our nation is having to pay for, and will pay for, atleast until the next general elections, which is well more than a year away...

HR are puppets and always listen to the managers, do whatever they say, even if they know that the managers are wrong. Most of the managers are biased and give better ratings to boot lickers and their friends. HR ignore the existing employees and offer better pay to new recruites. HR in Indian IT are data entry operators. They are not very useful except for clarical manial jobs.
hi All, i have a question too. Today only i received a offer letter. I am working with a multinational software company looking after asia pacific sales. in todays offer letter, my new company stated in one of the clause that if i resign for this new company in future, i can't work with another company for next 12 months who is in similar business to this company in whole asia pacific region. I work with FSI industry, and this is my area of expertise. In future if i want to leave this company, and if i cant work in FSI industry for 12 months, what i am gona do? Any advice?

Dear Shankar, This is the common practice employed by company.They wish to have controll over their knowledge bank(intellectual property). If it is possible for you to not accept the offer do so and if the offer is to resisting than accept it. You very well know the condition of justice in india. Thanks dear. I cant say no to this offer, and they are offering me senior management position. But as you said, they cant sue me in the court. Anyway, i wont be leaving company if i have a good growth. and if they cant provide me good growth and environment, they cant stop me.

pls remember they can very well drag you to court, and this isnt a criminal law - this is contract violation and its very easy to rule against. count on the fact that your next company could help you out by giving a different role than the company offering yu this job. but if the fine print is extended and they are talking about you not being able to work in this vertical itself - yu might want to consider your chances and then take the risk

are they talking in terms of job position or the field as a whole itself ? when yu take up your next job, you can always get into a role that can be defined as something else in the new company, provided the new company agrees. if the salary benefits are so great that yu can easily consider this company, and forget the liabilities later - as in the new job scene - where you can take chances go right ahead!

Work in other than FSI Industry 4 one yr and than Join FSI Industry...any way what will u do sitting at home 4 twelve months without work ...u will get boared man !

Check with them if this clause can be ammended or see what is the penality if u take up a job within 12 months? and also ask them how does it make a difference to the present company whether i join within 12 months or after 12 months. Not to worry, solution can be found easily as law are more employee friendly. Moreover, its ur will power to tackle any situation matters most. Dont imagine that company will spend on court / lawyer 1000's of rupees if dont follow the rules specified in the contract apart from issues arising out of malpractise / fraud etc.

Thanks Bro. This what i was thinking. They wont be going to court to sue me, just because i took another job in similar job. One cant expect me to work in factory after working 10 over years in FSI, just becuse i quit job in this perticular company.

dont count on it. indian companies follow US precedents blindly, and if the companies happen to be a MNC from USA, chances are they take their contract seriously.

You can fill up the bond because the bond is not legally binding and another option is that you dont need to resign just slap your boss so hard that make him throw out of the company.

boss, trade secrets can be protected. i think the company acts according to US laws. in the USa many companies including google and microsoft have clauses that prevent or are very specific against going to a rival at least.
and in case of trade secrets - the contract might hold good, and btw it need not necessarily be a bond.

legally ther is no such rule according to ministry of labour and employment so no one can claim on u,they are just thretening u, even u can claim on them for this statement in india and yes one more thing ,these rules will apply in india only ,am not confirm about external rules but anyhow ,in india u r safe....so go on
now a days all the govt. sector companies offer contractual employement.can any one plz tell in govt. sector how the contractual employees are different from regular employees.which type of benefits they don't share with regular employees.India's law is also againtst the contractual employees giving them no area of hope for to live them n being a regular employee.jaise law ke palle se paise ja rahe ho.
