This is a house occupation LAW, named domestic violence to fool people.
by on Oct 28, 2007 06:32 PM  Permalink

The one of the big aims of making Domestic Violence (DV) LAW is to occupy the house by wife. The name DOMESTIC VIOLENCE is given to fool the public.
The new DOMESTIC VIOLENCE law (from Oct 2006) sections 17 and 19, practically allows a wife to occupy any of the houses she had ever stayed in. The LAW says the house can be of a friend or relative or rented. It do not matter how much time back the wife stayed in the house.
Persons save full life for making a house they can stay in the old age. With this LAW they can lose own build houses to the daughter-in-law.
At least they are paying her a % of the house cost for out of court settlement due to this LAW. Which is wrong.

Big problems with this one sided LAW
by on Oct 28, 2007 06:28 PM  Permalink

Some big problems with DV (domestic violence) LAW in very first reading.

1.      Before there was 1 maintenance LAW, then in 2001 125CrPC was modified. So maintenance case are being filed by wife at 2 places, and try to get the maintenance judgment that is higher. With DV LAW people are now fighting 3 maintenance cases; the wife can take the maintenance amount highest in these. This is as expected adding to the multiple proceedings in which parties may already be spending out their time, energy and resources. This is against basic common sense, just because feminists LAW makers at WCD want to give more options to the wife.
2.      It is common trick by feminists LAW makers i.e., ministry of women and child development to add the controversial proposals, about which they get opposition not in the main LAW but later as part of Rules. Similar trick is used, 2006 Rules are significantly bad and one sided. Rule 14(6): Asking respondent by LAW to give undertaking that he would refrain from causing such domestic violence as complained by the aggrieved person. This can be done before any counseling begins. This puts the cart before the horse. It proceeds on the assumption that there is no reason to doubt that the respondent has committed or is likely to commit domestic violence. Then the Rule 14(5) says respondent shall not be allowed to plead any counter justification for the alleged act of domestic violence, this is unfair, the LAW prohibits 1 party from saying his point of view, which

Great Article.
by on Oct 28, 2007 06:20 PM  Permalink

Outstanding article. Rediff has shown what good journalism is about. Great Going Guys.
1. Lets save human race from wrong new LAWs being proposed by WCD ( Ministry of women and child development ). 1/3 of children in several countries are suffering in fatherless families due to feminists new barbaric unequal LAWs. These feminists are anti men and women with failed relationships and now want to make LAWs to promote breakage of families and harm children by fatherless children.

2. As a basic human rights , divorce afer 7 yearof separation should be made easier.

Laws like DV ACT is for Breaking Families, not for Making
by Gokul PR on Oct 28, 2007 12:17 PM  Permalink

If the parties in a family are valueless, what prevents them from misusing the law to put pressure on the other side to concede to their extortion and other such demands(in the case of DV act, its the girl who doesn't have 'fear of punishment' even if she misuses the law, and the law clearly states the respondent(accused) should be a man- so men are marked for death by the law).

What kind of intelligentsia do we have who frames laws so poor in their conception and implementation that as of now 'Protection Officers' are welfare officers who do not have time to spare for this role, leaving their original mandate of welfare of the ward/panchayat.

Who are these irresponsible law makers who jump the gun, even when the requisites of the written law is not ready. While police happily make a cocktail allegation by which they can mix DV act accusations with 498a/406 of the IPC and make arrests and be the pawns of extortion yet again.

We should react, and if we don%u2019t we all would find ourselves victims of these draconian laws, even if one is not married.... so think, and raise your voice while you still can!.

NCW should be headed by a successful grandmother.

"The members say that most women who have a failed married life head the commission."

This is so true. Not a single leading member of NCW is in a committed relationship.

DV Act
by GOPE LALWANI on Oct 27, 2007 02:37 AM  Permalink  | Hide replies

Once the wife goes to the police station, that is the end of
the marriage, and for the husband she is like a dead woman.

The government should think of some other mechanism to save families
and marriages. The law should not break marriages and families.
Without the Draconian Laws, the marriage would survive and most
importantly, she would survive as wife. DV law is making the women to
jump from frying pan to fire. DV Act is only breaking more families and generate more awe in men towards relationships.

No amount of threat is enough to chastise a self-respecting person (Husband)
who compromises with his best efforts till the point, he breaks down and
can take no more!

Threats can never be the foundation of any relationship and more so
a marriage. You can oppress a man only up to a point where he is still
just allowed to feel his fear of indignation and disrepute in respectable society and has not been outweighed by the burden of his very survival.

RE:DV Act

Well said Lalwani,

India is in a deep slumber. These family less people from NCW want to turn make every woman family less and suffer just like them. NCW and Renuka Choudary must be declared terrorists, as that is what they are.

Thanks,
Rajesh

DV Act should cover parents and sisters of husband atleast if not husband
by jinesh zaveri on Oct 26, 2007 08:41 PM  Permalink

males should be allowed to record complaints with police which are enforceble under the IPC. There should be a law that protects husband and also that protects the parents of the husband from Domestic Violence. a law that punishes the trouble some wife and her relatives.

Since there is no mechanism for recording complaints of male against wife the statistics at national level is only one sided. further the complaints of wives have proven to be accurate only in 2 % of the cases in spousal abuse.

the act is hollow and the drafting should be improved even supreme court and high courts of some metros have affirmed this. Let us be proactive in opposing this and not wait till we become victims of this law/act.

There has to be a review and reality check.

RE:DV Act is needed

What bullshit!!...There are enough and more laws in the Indian Penal code which can be used by such women to tackle their problems. This in no way gives equality.I might sound like a chauvinist but this is another one of them Bullshit laws which gives men hardly any say in domestic matters in India.
Think of it.Who in the hell is targetted for such a law.Is it the lower class people who face such issues and still keep mum about it.Or is it the middle class in which women are usually given equal say in matters these days.Think of the future and think big India.Think about equal rights for all, men and women, Hindu or Muslim should be treated alike under law.My views, and may each man have his own..cheers

Extent of Domestic Violance
by dayalpd on Nov 26, 2006 06:59 PM | Hide replies

The law is one sided and in the present day urban environment Woman exploit it to harrass husbands/male associates for a ransom if they do not yield to the woman's unjust demands or action including adultary.
The law should be both sided. There are cases where woman want to lead independant life and mix with men for flirtation or and sexual relationship even if they are married. If the husband or male associate objects to these acts, the woman can inflict self injury and file a case against the husband/male associate under this law and may get the male partner penalised even if they are innocent.
Either there should be another law or in place of "woman"/wife it should be ammended as "spouse"
