The problem is with low national character. On that spot were people like commissioner of police who also chickened out.Who could threaten a police commissioner? And even if it could ,should have he relented? He should resign. It is incorrect to say that social bonding is there and no one will give evidence. That is stupid and crazy argument and points to lack of character.Indians do lack character. We are cowards, selfish and greedy. We want to keep out and be in comfort zone.My home,my children ,my earnings,my comforts. That is all we can see. As regards police investigation. The whole organisation is bunch of goondas in unifrom, corrupt and arrogant lot.Why they do so ?First, because of above character problem.secondly, permanency of governemnt jobs and corrupt seniors turning blind eye.Police rules are foolish. These should be like of army.Strong action is required.Every policeman indulges in bribery. The senior officers wag tail before politicians for allotments of plots, plum postings and comfortable stations. They are characterless lot.As regards law, it is absurd and outdated. Why witnesses are not recorded immediately within 36-48 hrs of crime by special duty magistrates?
We deserve what we get. Corruption, Manipulating laws, thwarting justice has become so ingrained in our lives that we have learned to live with it and consider it as given as mother nature.
With the society like this we cannot expected to get a more liberated and well-oiled justice system.
The Nation stands in shame.People who are known to Jessica or who ever present in that party are not even bothered to come out and ensure justice for her soul.If they close the mouth tight it will happen to them tomorrow why don't they understand this. Common Citizen like me started feeling that the law and order,Justice in this country always bend for the Affluent, Politician and Burocrates. when are we going to protect the eyewitness like in Developed countries.(Oh I am sorry India is the land where criminals are protected by law enforcement authorities and Judiciary sytems)
It is very easy to say that the eye witnessa are coward.what the protection our system provides to these people. It is very easy to comment, write articles. We all know how the honest people are tortured and butchered in this honest system. Was not Satyendranath Dubey a honest person? Was Manjulnath a culprit? What about the death of these honest person and transfer of Ronald Ferriero? What the system has done to them.Even our highest office and highest person did not raise a single word about the incident. If the country still want the people to sacrifice their lives for causes, then provide them adequate protection else don't put any comment on them. What type of punishments are given to rapists are widely known and how much of quality and justice is given in our courts is known to everyone.writing articles on cowardice of such eye witness won't reduce the mess but let us introspect how much are we also contributing to this mess.
The real culprit is in fact our system and time. We can understand that an incident like the Kanishka Bombing taking years to be investigated and tried in court. But the Jessica Lal Case coming to court and for a verdict to take 7 long years is a failure of our system. Any reports ballastic/forensic etc. in this case should not have taken longer than 1 or 2 months. Why then did it take so many years, when the case could have been decided and shut within 6 months at max? Is it not a failure of our system ? Perhaps time must have muted the eyewitnesses sensibilities to Jessica. I was in college at that time and i remember feeling outrage at the incident reading it in the papers. But when the verdict was given I had to jostle my memory cells to recollect the case. This in effect is due to the passage of time...though for the family members of Jessica, this time would have been painful...they had to wait so long for the verdict...and suffer after the acquittal. Perhaps if the verdict had been fast, they would have got on with their lives....
Jessica was murdered in presence of many. The culprits could not brought to book because the witnesses didnt cooperate and the investigation was messed up. The court is equally resposible. It can free the accused in the light of facts presented before it but the fact that the murder took place and someone is the murderer can not be overlooked. In many cases the courts take suo moto action on media reports, here much more was before it, still it failed to reccomend anything for tracing the murderers. If a citizen is murdered in such a situation and the investigators and courts fail to find and fix the criminals, why the State should not be held resposible for the murder? For failure of various organs, why it should not be forced to pay a heavy compensation to the family. The compensation should be recovered from those who investigate and decide the case.
Brilliant piece - Indira Jaisingh. Bina Ramani & her 'high-society' callous cronies reflect India's shame: truth is OK if its convenient. Lying and/or prevarication is a way of life.
We are becoming a nation of liars - in all respects -our dates of birth, our commitments, our statements - public /private/ queries in parliament. Even murder is not too big an issue for the truth to be told.
I hope Bina Ramani and cronies get hauled up/even jailed - for interrogation. I hope Manu Sharma's father is asked to step down from the ministership.... and the judge himself gets investigated.
But we need to ask ourselves: am I concerned for thr truth in my daily life ? Would I have acted differently if I were one of those witnesses to the murder??!!
