Fatwa on Imrana lacks the references from the Holy Quran
by Md. Ali Siddiqui on Jul 05, 2005 11:39 PM  Permalink

These semi literate or illiterate ulemas and mufties are doing more harm to Islam than any one else. They go on passing fatwas without considering it's post consequences and they are so arrogant that they even don't want to listen any logical argument. Sometimes they pass edict of their own choince in the name of God and the illiterate muslim masses fall pray to it. Fatwa passed on Imrana is a true example. It lacks the reference from the verses of the Holy Quran or from the Hadith which are the source of the shariya.

Imrana case
by jaideep on Jun 30, 2005 01:38 PM  Permalink

The ridiculous decision in the Imrana case is a case of "the devil quoting the scriptures". Otherwise which religious person would be so inhuman and sadistic in his attitude. The same goes for the All India Muslim Personal Law Board. Finally, all these leaders/ maulvis have once again lost an opportunity to bring Muslims back into the mainstream, by indicating that following the Shariat is priority, Indian law is optional.

Imrana Edict
by mansoor on Jun 30, 2005 11:52 AM  Permalink

The Fatwa issued on Imrana's case is baseless in the light of Quran and Sunnah (Teachings of Prophet Mohamad). Here is the answer for this case that i requested from a scholar.
Dear questioner:
Al-Salâm `Alaykum wa Rahmah Allah wa Barakâtuh.
We heard about this issue from another source without it being attributed to Dâr al-`Ulûm Deoband. We seriously doubt that Deoband would issue such an obviously erroneous verdict.
Such a ruling could never conceivably come from a proper Islamic judge or Islamic court of Law.
There is either a miscommunication somewhere or this came possibly from some tribal council in complete and utter disregard for Islamic Law.
A womans father-in-law is mahram to her. There is no way on Earth that he as a mahram can ever be lawful to her in marriage any more than her own father could ever be lawful to her. It would be sinful for her to marry him or to willingly have sexual relations with him. She is not sinful for having been raped, since that was against her will.
Under no circumstances can a woman be compelled to marry a man, least of all the man who raped her. He is a criminal in Islamic Law. She cannot b

this is heights of injustice to a woman,
if he is sexually assaulted by her father in law, that means that she cant live with her husband? it is a serious offence and the in laws have to be punished by law,
punishing the victim in the name of religious ideologies is absurd
itz time for women activists to show their presence for a right cause.the muslim board has to think seriously on this issue and make sure that she lives with her husband , provided he doesnt have any role in this crime
awake muslim board awake, and stop not till all these unsocial laws is abolished

Unfair edict
by N G Nileshwar on Jun 28, 2005 11:07 PM  Permalink

the edict says imrana should not live with her husband. could she stay with the person who raped her? then, was it rape at all? and what is all this rucuss about?

just as the reform of laws pertaining to sati, dowry and the like have been legislated, why could not there be a law to uphold human values? would a muslim have the priviledge to rape and escape by virtue of the application of the personal law?

does the muslim law permit rape? if no, then where is the dispute of application of the indian penal code and the cr.p.c.?

a rape is a rape. there is no hindu rape or muslim rape or christian rape. if rape is considered to be an offence, let the law of the land prevail.

if a hindu man raped a muslim woman or a muslim man raped a hindu woman, would the law be adapted by their religion?

atleast here, let there be no politics. once again, a rape is a rape and should be considered to be a rape. religion and politics should not and can not be mixed in such cases.

by Rizvi on Jun 28, 2005 09:05 PM  Permalink  | Hide replies

You big, big experts, do something to no only save the honour of this innocent woman but to let her live her life and to take care of her children. It is sheer nonsense to keep on reading these big, big guys sermons; all this shameful bla, bla has already crossed limit of disgusting behaviour on part of everyone involved including the 'sermon' giving specialists / experts. Will atleast educated moslems come forward and do some thing positive to take care of poor Imrana and her children? Rizvi
