Sir:

What are the remedies available to the employee, if the Provident Fund is not refunded by the employer/
can someone throw more light on this?

PF atrocities

Thanx that you raised this issue....I worked for one of the biggest PSU oil company in India. My PF was withheld for more than 14 months.....reasons I had a bond of 1 lakh( on account of my sabbatical). My PF was several times higher, I asked them to pay the balance... company HR refused...I had to borrow personal loan at steep rate.

Since I was not working the time I resigned, I asked for refund of all PF and Superannuation fund amount since I worked for more than 9 years with the company they are yet to pay my MONEY.

I wish redressal system was there to sort issues like this faster....and also such HR officials be made answerable....

Can ex employers hold back PF

Sir

Only the statutory requirement to be fulfilled before claiming the PF is that he should be unemployed for a minimum period of two months from the date of resignation from the previous employer. This also relaxed when the employee is leaving for abroad. If the previous employer under any circumstances refuses to sign or withheld the submission of PF form the employee can directly submit the same to the Department by obtaining the signature of a Gazetted Officer as narrated in the rules. The department will call for the details of Form 5/10/3A particulars from the employer. Hence under any circumstances the PF form cannot be withheld for submission. It is the statutory obligation cast on the employer

With-holding PF

I think, the employers do not have the right to with hold PF amount. It is true that they do not process PF until and unless you do not give a proper notice period or break a bond.

But this is absolutely wrong. My PF is not yet transferred from mm previous employer and its almost 3 years now. PF control should not be in the hands of the employers.

There should be a unique PF account per individual and all contributions should be made to that particular account.

If you switch, you only need to give your Permanent PF account no. like (PAN) and money should get deposited there.

No HR or companies dependency ......

Can't understand why everytime a new PF account is created for new employers.

The system needs to be changed, Isn't it ..

REGARDING HOLD BACK PF

Dear Gaurav Vasudeva,

No one employer can hold back PF of any employees, you have submitted form no.19, 10c and NRS form in provident office, if authorised person of your company is refused to sigined in yours withdrall form then you have go to your bank manager and asked to signed in your withdrall form and submitted regional provident found office.
Notice period or notice pay is not a matter to hold pf.

Can Ex-Employers Hold Back PF

Dear Employee....
Even I feel the government should amend this rule..

How can an employer hold back the PF amount or even delay.. Why this power has been given to the employer. Many employee suffer because of this policy(he has to waste his time for PF after he resigns ). I think this need to be scraped immediately This is the hard earned money of the employee and he should get this on his signature and not after the employer has sugned this. Can some body tell me why this system of employer giving the nod for PF...

We should fight all this and also any other system(most of them in favour of employers)....Now a days it is the employee who suffers... I hope Mr.Chidambaram will help us out of this ..

It is our money and we should get this without any interference of the employer ..

Even govt. companies do that

Its a sad state as the HR department feels that they are the owners of company. I am told that even govt. companies like Maruti Udyog do that. I do not know if the PF commissioners can be of any help in this. Any suggestions or experiences???

The PF amount should not be held back under any cricumstances at
the instance of the employer. The PF money once given to the PF trust
should be adminstered without according any say to the employer.
The employer have several harassing employees who resigned and
are about to resign. The PF claims should be settled without any
reference to the empoyer.
