When we are involved in a LICO (low intensity combat operations) - like the one happening in kashmir or north east, where the enemy is normally unseen and could be anyone, including your next door neighbour, there are times when such collateral casualites do happen. No soldier or no police man is saddist to such an extent that he wantingly kills innocent.
These killings happen either because it was prooved beyond reasonable doubts that the persons in custody are eithe dangerous people or helping dangerous people - but without any legal evidence and therefore letting them loose will be a serious treat to the society.
but many times, it does happen that due to mistaken identity or due to a personal rivalry between the guy in custody and an informer, wrong information are passed on to the interrogator - who when using 3rd degree interrogation techniques, find that the line has been crossed and letting the guy in custody to be free will be more unacceptable than killing him....thus he is forced to kill the guy in custody.
Believe me, I have done it when I was in the Army - and I never liked it..but neverthless had to do it....
