Increasing the no of judges in SC
by samir banerjee on Feb 21, 2008 07:18 PM  Permalink

It is time the Govt realised the need to increase the number of judges in Suprime Court.
They should also realise that before these Judges take up their posts adequate office space
man power and other infra structure are in order for their functioning. The way the Judiciary need be looked afetr that they have no scope or desire to corrupt their mind and be fearlessly straight and honest. The best person
be there irrespective of caste, gender or anything.A suprime court justice must be honoured at all level to uphold true democracy.

Only people from same caste will 'understand' the problems of their caste people.

Only people from same caste will 'understand' the problems of their caste people.

Hence Government of India should implement 'reservations' in Judiciary.

1. 52% of Judges should be from OBC communities.
2. 35% Judges should be from Dalits and Tribals.
3. Remaining Judges should be from other castes.

So what if the population of India has increased five-fold?. It does not automatically warrant an increase in the size of the Highest court of the land.
To quote an example, the size of the Supreme Court of the United States was originally set in 1789 to a maximum of SIX (6) judges. With the growth in the geographically size of USA the maximum membership of the US Supreme Court was increased to SEVEN and in 1807, and then to NINE and then in 1837 and finally in 1863 to the current maximum of TEN (10) judges. In the meantime the population of USA has increased many fold but you don't hear the Americans (public or establishment) complaining about the small size of their Supreme Court.
As the say Quantity is no substitute for quality. Even increasing the size of the Indian supreme court to a Million judges will not necessarily improve the productivity of individual judges or the Indian judicial system for that matter.

Augmenting Judges' strength
by vasanthi kannan on Feb 21, 2008 02:32 PM  Permalink

How long it will take from today to see these additional 5 judges occupy their seats. Then what about State High Courts, District Munsif Courts, etc? Let someone bring this to the notice of Hon'ble Chief Justice of India

Why only 30?
by RAVI on Feb 21, 2008 02:30 PM  Permalink

To clear existing pending cases, we may need 300 judges. We have 5 million central government employees. Why Government cannot reduce Lacs of people from other departments and increase strength in courts. Lead time to clear cases is the main hurdle for our infrastructure growth. Some X, Y will file case for land dispute for any infrastructure project., and case will be pending for years together.
