Supreme Court over Parliament

I think until we have well meaning politicians who work for common good (instead of the current corrupt, power hungry, caste based politicians), the supreme court is better to ensure law and order prevails. Can any of the current politicians say that they win an election fair and square? How many of them face muder charges, extortion cases?
I sincerely welcome this judicial activism. If it fails, we will find another way of ensuring justice prevails.

The supreme court judges are more learned and more sane than the majority of the MPs except maybe one or two MPs. So I would prefer the Supreme Court decided things rather than the Parliament.

Faith in supreme court

The people of this country have more faith in supreme court than the legislature and executive combined. Its time for some deep introspection by our LEADERS, which they will never do.

Supreme Court over Parliament

The Parliament is no longer able to protect the general well being of the countrymen. It is a place for petty vote-bank politics and there is a lack of overall leadership and rightiousness of the parliament. It is no longer a place for a secular, democratic and logical values. What the Supreme court has done is very good for the well-being of the public - and the main reason for that is the supreme court still works in a logical, ethical, secular and constitution-abiding manner - which the parliament (particularly the ones under the Congress party) has always failed to do.

the article as well as concern of ms.jaisingh is praiseworthy.however as of date citizen feel more secure with judiciary than the gentlemen sitting in parliament who are bent upon to sell this nation to foreign capital. badri nath

Not all laws will be removed

Its not as though supreme court will completely remove all the laws inserted in the Ninth scd.I think what has been written here is as though all the laws inserted since 1973 will be removed from this scd.This will not happen and this judgement says that the laws in this schd which was previously immune to scrutiny can be challenged.So I feel this will not change any existing laws related to Land reforms if they are for the public benefits.
Somebody correct me if Iam wrong.

the work which should have been done by exective and legislatives is being done by judiciary becuase these two class if people are intrested in vote bank politics.

Tone of the article

I am not very clear on what the tone of the article is. Does the respected author mean that such a power to the Supreme court is not good? The words such as "Unaccountable" in respect of the supreme court are strange to digest. While it is true that there is a lot of activism by the Supreme court, the court has set excellent examples. And in a situation where the law and order of the country is deteorating, the Supreme Court is trying its best to better things.
While the author is correct that the Supreme Court can make judgements that are not in the best interests of the nation at times on the notion that they interfer with the fundamental rights of the country, there have been no examples (correct me if I am wrong) where the Supreme Court has taken a decision without proper reason and rationale. I am personally happy to see mor epower with the court rather than see the power in the parliament which is increasingly using the power for self gain and not for public merit.

for a moment i thought this piece was written by sitaram yechury. The leftist psudo intellectuals have this thing about control over other peoples lives - reserve/license/control in name of poor while travelling in facny cars and staying in fancy houses and our expense. The only way for upliftment of poor - capital infusion / industry / entreprenuership is anaethema to them. If it were not for the Supreme Court, the better off, tax paying citizens of india would be robbed of all their right to property. Specific to ULCA & rent control - pl note the hypocrisy & irony - Politicos like deoras and businessmen like Nusli Wadia (Bombay Dyeing boss) live in a rent controlled houses, pays less than 500rs pm whereas we slog our bums off to live in 2room matchboxes for 40k. i can't wait for the day rent control is repealed!

As usual, Marxist intelligenisa are crying wolf over a perfect decision. It is only because Judiciary was subservient to Legislature that India has come to such a pass.

We do not need a Government which tramples over fundamental rights just to oblige the so called progressives of the society
