Indira Jaising's article is very much disappointing. It is biased & appears to be politically motivated. If our politicians, who are only interested in petty political gains than any good of this country join hands with such lawyers, only God can save the Country !

11 Jan 07 Judgement of Supreme Court

The fact that the Parliament is manned by Polity's elected representatives obligates it to legislate in People's interests under the overall expectations embodied in India's Constitution. As a constitutional body itself the Judiciary has the responsibility to ensure that the Consitution is upheld at all times in tune with the prevailing conditions.The judgement of today formalises this. So we should celeberate the same and also commemorate the same every year.After a long time a national event has taken place which gives us the reason to hold our heads high!!

We Respect the Supreme Court Verdict

There is no need to twist the effect of the supreme court verdict.
It is really excellent verdict!!!

Who ever is having littele brain and real sicererity will definitely accept the supreme verdict.

"WE RESPECT OUR JUDICIARY SYSTEM AND THE SUPREME COURT"

We can't trust the dirty politicians any more who are spoiling the country with the dividing policies.

We the Indians are lucky to have a professional Military, Professional Judiciary System and a Visionary Prime Minister Dr.Manmohan Singh and a visionary President Dr.Kalam.

The problem we have is the dirty vote bank politicians.

Thanks to the Supreme Court.

Ninth Amendment

In the light of corrupt political leaders, Supreme court must and should always be supreme. Unlike our unqualified politicians, supreme court judges have conducted themselves with courage, morality and impartiality. Moreover, if we look at the way our democracy functions - few leaders forcing a party whip to pass laws is probably most unrepresentative, even ignoring the fact that most ruling parties these days, do not command more than 35% of the votes polled , which is again around 60% of the electorate !

69% reservations in tamilnadu to go soon or latter

Jayalalitha, as the leader of dravidian party( whether she likes or dislikes)to stisfy DK and for her own safeto of political power, went to Sankardayal sharma and got the 69@ reservation entered in the 9th Shedule of the constitution. I single man liike sankardayal shrma can not degrade merit in Tamilnadu. It has to be done either by constitutional ammendment or by supreme court law.It is shame in Tamilnadu that merit has less than 31% value.

Comments from Indira Jaising seem to be heavily biased against the S.C. which unfortunately is the only functioning institution having respect and trust of one and all. Indira is talking only in theoritical terms when all the democratic bodies like Legislature, Executive and Judiciary are responsible and accountable to the people. When the Legislature and Executive are highly corrupt and inefficient they cease to enjoy confidence of people and hence have to give up the POWER.
I am sure most law abiding and common ' aam' aadmi will fully support the S.C in this landmark case. Three cheers to S.C.

No doubt this judgement is to be welcomed by all since it puts red flag on all those deeds of the legislature which do not adher to basic structure of the constitution. Be that as it may , now the question is that the supreme court will itself decide what are the basic features of the constitution since these have not been finally put on paper. One court may think at one point in time one issue being essentially a basic feature of the constitution while the other court may not think so on the same issue. Indra has raised a valid point in her article that since our judiciary is a nominated one it has become the final arbiter of various issues being basic features of the constitution or not.In all fairness, it may not be fully in tune with the progressive democratic aspirations of the nation as basic features of the constitution then must also be specifically defined.

Dear Ms Jaising,
We thank you for an elaboration of the 9th schedule.

But you could have done without the second part of your passage - the impact of the SC ruling. This is just the climax of the increased role the apex judiciary have been playing in the recent times, to give the fellow countrymen what was promised in the constitution some 60 odd years back - 'A Govt. for the people, by the people and of the people'.

We all know that 'too many cook spoil the food'. That is just the case today with our Govt. Instead let the wisdom of a handful of truly educated (not literate) people speak for the nation. And you see the outcome - the messages here that follow your passage %u2013 a true reflection of the social mood. So let the judiciary takeover - at least for the time being, till it gets tainted and needs a replacement.
As a final word, never mind on the accountability of the judiciary, lets%u2019 recall the Jesicca Lall case and you have the solution - the young India has started realising its bigger role - as appealed by Swami Vivekanada a century ago.

I do think that the point raised by Ms.Jaising is a valid one that the SC might be in a position to be the most powerful and yet the most unaccountable but with politicians the way they are, it would be a safer option to leave the administration to the judiciary rather than leaving it to the politicians / criminals who are ruling the roost in our country now. I guess this is how the bulk of my countrymen would think, too, people who keep away from politics, at least.
