check the income tax and other tax returns of all traders of so called illegal shops
by dinesh on Nov 17, 2006 11:14 PM  Permalink

the traders of these illegal shops should be scrutinised on the following points before granting any amnesty to them:
1.how much income the trader is declaring to the tax authorities
2.by tax records is it worthwhile to allow him such a big illegal shop
3.what has he contributed to the welfare of the area in which he is carrying on illegal business
4.does he own properties and other assets disproportionate to his declared income

the honorable SUPREME COURT has done a yeomen service to the historical city of DELHI which the corrupt politicians and their illegal cronies are out to DESTROY

Why Sealing
by Sanjeev Bhasin on Nov 17, 2006 04:34 PM  Permalink  | Hide replies

Honble Supreme court has to take the following points in to consideration:
1.A problem of 50 years can not be solved in 1-2 years
2.Solution to one problem should not lead to another and equaly big problem
3.A law that adversely affects lakhs of people and requires paramilitary force to implement needs to be reviewed
4.Trade itself is a "Legitimate" activity (maybe the place can be questioned at this moment) and as such the law should not be instrumental in hampering the trade
5.For the "illegitimate" place, multiple parties i.e. Government, MCD, DDA and traders are equaly responsible. Any judgement should punish all the parties and should not discriminate

In the nutshell, trade should be allowed to continue till adequate alternate commercial space at reasonable rates can not be provided for relocation of traders as continuation of trade and commerce is in the interest of everyone.

Dear sanjiv,
I read yours comment
I want to tell you that the problem is not occered in last 50 years it is come on light last 10-20 years before 50 years delhi population is only 7 lakh and now 1.50 crore.

second if we respect to law they why are not traders, the meximum traders are very corupt they encroach the govt footpath, chhajja, and also income tax and sales tax. they do not want to cashmemo which you purchased.

third if anybody did the unlawfull offence they must face the punishment.

sealing of shops in delhi

Point well taken that the Honorable Supreme Court of India wants the rule of the law to be supreme. Also that Delhi has grown into a mess. BUT, the moot questio is :
1. Why the civic authorities allowed this in the first place? Simple reason - they all took bribes to close their eyes.
2. Why other law violators e.g. Anantram Dairy/Sainik Farms residents not being touched? Simple reason - many of the lawmakers/judges living in these unauthorised colonies.
3. Is the Court and the Government fully aware of this overnight action of extreme atrocity? Atleast 40-50 lac people will lose their means of livelihood.
4. To earn for one's livelihood is everybody's fundamental right. Then why this action to deprive people in general from earning their daily bread through legal means just because some legal technicalities of use/misuse of land is in question. Since the government could not fulfil its plans as given in the earlier master plans, why common man is being made to suffer????

All this smacks of a bigger conspiracy pointing to nexus between big lobbies (read MALLS) and those who are in seats of power. Is this the same democracy cherished by one and all??

Sealing Drive in Delhi
by Ranjeet Reddy on Nov 15, 2006 05:47 PM  Permalink

Can we call a horse - Donkey if we all decide to call it donkey from some specified date? This action looks like that. There has been some wrong thing which happened from past so many years and our executive body has been sleeping on the issue and ignoring all this illegal acctivities. Now if judiciary is taking active intrest in the issue and trying to make our cities a peaceful place to live, should we have objections? I feel the court should take action on all officers who are responsible for such acctivties with retrospective effective effect if they are alive.( Some of them would have experied). I think we all should support the court in this endeavour. This shows the clear failure of successive governments in discharging their duties. Should we balme overselves for this sorry state of affairs for electing such governments?
