My father is a lawyer in a district court in Bihar. He has to file a case under Domestic Violence Act 2005, but the State Govt. has not appointed any Protection Officer (PO) yet. A PIL has been filed to the High Court, Patna, but the judge suggested to ask for PO from the state govt.
Now, in the absence of PO, the local court is seems to be confused how to proceed. Who will deliver the notices to the accused? The definition of Law is not describing this part of theory.
Can anybody suggest me hot to proceed the case to get justice?
Indian goverment is coming up with policies like this will increase the conflicts in the metros.The nation has far too many issues to solve for the population.This will not only create a hostile enviorment for those households that are living jointly but will make the nation households nuclear.
The wife's will now demand that Son's don't care for the Parents after Marriage as they grow old because this will make the Head of the family(husbands) to part with his earning that are no more his because he has a wife and family.
Why is the goverment not coming with a policy that will make it essential for the daughter in laws to perform all the duties for the in laws(Support them emotionally and financially) and if they are not able to put then behind the Bars without a bail.
To cut the things short the rule empowers the women and make Men vunrable.
Well hats off to your playing cards.It is a fact that mininsters to save there gaddi make use of caste system and see that innocent hindu muslim fight with each other, burn each other houses and than later on these people go and play mokery in the name of aasu pochana and all that drama.

women think that this law will protect so they will only support u without realising that u are not even remotely concern with women plight.

It is people like Ahimsa Anand who are willing to blindfold themselves to realities.
Sonia & team did a wardance when Fernandes made his remarks based on the intelligence reports that he was recieving. They wanted his resignation. They wanted his apologies.
Nehru who had a global vision, was unfortunately blind to realities of politics. He tried to be a visionary. If it had not been for Sardar Patel we would not have a united territorial India.
VKK Menon was made a scapegoat for Nehru's dilly dallying over how to deal with his failure of "Hindi-Chini bhai-bhai".
The Chinese have more than enough space for its increasing population. What they don't have & what they want is an access to a year round port in the southern hemisphere. This is a minimum requirement for an emerging super power.

It promotes hen-pecked husbands but those too for only that period in which they can keep their wives happy and satisfied by providing them with money, good house, all possible luxuries ,comforts, unhindered and unquestioned sex(either with husband or with any other male outside relation). If for any of these things, the women feels deprived of, she may feel hurt emotionally, mentally and/or verbally and then she can choose to exercise her right to send husband and his family in jail for 1 year just by lodging a oral complaint at police station/courts. This domestic violence law is one which puts Talibanies in Afganistan to shame when it comes to comparing barbaric, inhuman and gender biased(in this case orthogonal to what happens with Taliban) nature of both.
Women organizations working 24×7 on vote bank political agenda have drafted this Domestic violence act just to manufacture a sense of awe, havoc and threat in society. After all that is all what sells in Indian democracy. Domestic violence laws is highly biased and anti male and is solely meant to destroy institution of marriage. The domestic violence act is based on the conjuncture that all women are pious, truthful and devoted and all men are bad, brash, cheaters, useless, good for nothing drunkards who are born in this world only and only to demean women. This domestic violence is meant to create a victim, a prosecutor and a judge all rolled out in a single unscrupulous and egotist wife. The domestic violence law is so badly designed that it robs husbands of even their fundamental rights to live with peace and dignity. Languishing in totally Corrupt Indian judicial system and courts for years just to prove that you are really innocent and not as has been alleged in false complaint is tantamount to being destroyed and massacred. It is ironical that we have missed out the no. 1 violence in our society wherein a girl child is deprived of parental assets. The day that happens, most females will be able to get their rightful place. wonder why lawmakers don't take it up as a public interest litigation. I strongly believe this will have a multiplier effect towards improvement of our civil society.
As the law explains it will stop the domestic voilence. This cant be assured as there are chances of misuse of this law. This law is incomplete till one gets to know what will be the punishment will be awarded to misusers. If possible also publish the punishments awarded to the misusers of the law.
