Constitution laws needs amendment on this issue. It was ok in the past when the SC/ST were neglected for any facilites.
Now they are standing on the same level as any other castes They get all faciites what other gets. So why they should be given preference that to with less % marks.
If at all they are considered let them be competetive and then can be given preference if they qualify in same level.
It is dangerous too if the less qualified doctor is traeting the patient and some how due to less % in marks he has been qualified as doctor and cannot perform in the same capacity as the efficient doctor.
Simillarly for engineers and other resposible positions the country can suffer lot.
The time will come when thru out the world pepole will be sacred to take Medical services from Indian doctors collectively due to such reservations in responsible positions where Indian economy overall may suffer.
Resevations should be only in Govt Services like Post& Telegraph, railway / air & Bus services canteen services In Engg - qty serveyours , planning errection supervision , projects, Business opprtunities to them by sanctiion loans.

What about them who are getting appointment without qualification in government with help of nepotism, corruption etc. You should also make hue and cry for that.
It is really a landmark judgment. We can see many examples of setting aside the qualified for the need of completing the quota. The higher qualified people remain jobless or work on lower posts leading to discontent & apathy towards work.
There is another request I want to make to the honorable Chief Justice of India through rediff that,
as there are enterance examinations at every level of profeessional courses, there should be examinations conducted by an independant agency like UPSC , for accredation of deserving candidates from reservations & non reserved (Open) categary. The merit list of the exam should be taken as the shortlist of the selection process . The job should only be given to those persons who has a basic understaning & knowledge required for the post. This will reduce the chances for corruption as well as can provide oportunity for deserving candidates for promotions. Even there should not be any job gaurranty; every one has to go through an examination process after a fixed time interval & needed to be accredated at a designated level. It will make the system more efficient & understanding
Merit should be the sole criteria for appointments and admissions in educational institutons. However some concession to the members of educationally and socially backward , downtrodden communities like SC/ST is the need of the hour to undo the injustice meted out to them for centuries.It is unfair and against social justice to grudge such concessions. It is surprising that the indian society and judiciary is often silent about merit being ignored where there is money power or other kind of influences. In India nepotism,not merit, is the only virtue needed to go places. So why deprive SC/ST applicants a few seats in colleges and promotions?
Hope this judgement is upheld & implemented properly without finding loopholes in the law.And that this proves a step towards the betterment of our society. Rizwana Kashyap
I really appriciate the verdict. Hats off to them. Quota should be given only at lower level and to move up further, they should get through the reqd qualification and test procudure, so that important decisions can be taken in right perspective and correctly for the common man.
All the institutions should follow the same rule or unformcode, so that our children can see a better tomorrow.
The judgement as reported sounds quite sensible and restores some faith in the future of our society which is being destroyed by ultra corrupt politicians and spineless bureaucrats. This judgement hopefully will uphold merit to some extent. If even after more than 50 years of Independence, basic qualifications have to be sacrificed to push through half baked incompetent people, then the independence quite clearly has been turned into a sham!
