It's the same story all over the world. Governments "use" the judicial system to achieve their own ends. In the present instance, the Paki govt deliberately neglected to present a strong case. Now it can flaunt the court's decision to plead helplessness.
This stratagem is also frequently used in an aggressive way. In India, the top management in a certain govt scientific organization persuaded a low ranking staff member to file a a weak petition, just a few pages long and virtually bereft of supporting argument. The petition was heard by a Constitution Bench of the SC court along with several other matters pertaining to a few Public Sector Undertakings. The SC decided that the said scientific organization was not a "State", and thereby closed the door to all the staff to getting their grievances heard in an HC or in the SC through writ petitions.

First house arrest and now court ruling to release him are the two sides of one coin Musharaff playing against the pressures on him. The terrorism is one of the strong lessons in warbook of Pakisthan and
sponsored by Musgharaff himself in the past. Hence,
he finds difficult to remove it out as the terror
has now become a huge animal beyong his controls.
