It's the same story all over the world. Governments "use" the judicial system to achieve their own ends. In the present instance, the Paki govt deliberately neglected to present a strong case. Now it can flaunt the court's decision to plead helplessness. This stratagem is also frequently used in an aggressive way. In India, the top management in a certain govt scientific organization persuaded a low ranking staff member to file a a weak petition, just a few pages long and virtually bereft of supporting argument. The petition was heard by a Constitution Bench of the SC court along with several other matters pertaining to a few Public Sector Undertakings. The SC decided that the said scientific organization was not a "State", and thereby closed the door to all the staff to getting their grievances heard in an HC or in the SC through writ petitions.
