Rigorous Punishment
by Karthik on Nov 13, 2005 05:25 AM  Permalink

The extradition treaty with Portuguese insists on not giving a death penalty to Abu Salem. We must honor these obligations.

So the ideal punishment for him would be 25 years rigorous imprisonment in a dark room without parole.

He sould not be allowed to see the light of the day for 25 years.

Why not?
by Sougata Dhar Chowdhury on Nov 13, 2005 04:48 AM  Permalink

What an irony! Do a small crime, you get punishment as per law, and do henious one, killing huge number of people, for secirit rea on you will be flown in plane from Delhi to Mumbai, there will be red alert in places, regular flights will be delayed for more than couple of hours!
If there is a charge on you of murdering a person, you will be locked in dark cell in police custody and will be transported in police van which are out of shape. But if are a 'VIP' criminal, you will get VIP treatment during trial! This is Indian judiciary.
Law must be equal and uniform for all.Salem should be treated according to the degree of crime he has done

Don't take a soft stance towards criminals
by Chandrasekar Venkatraman on Nov 13, 2005 04:43 AM  Permalink

Although the contention of the courts is justified in saying that the CBI cannot produce a criminal before the court with pre-conditions, the ground reality is certainly different. On paper the court is correct, but as usual on practical ground, it is an ass. If capital punishment is not possible, Salim & Monica can be kept in solitary confinement for rest of their living life with no chance of a parole. I don't know why India is still sleeping over Dawood and Co!

Death penalty for Abu Salem
by raghavnk on Nov 13, 2005 04:20 AM  Permalink

India must honour its commitment whatever it may be. Otherwise any effort at extradition of criminals in future will be fruitless.

Death penalty to Abusalem?
by vengatampally on Nov 13, 2005 03:43 AM  Permalink

What else to a born criminal terrorist who made a series of bomb blasts in bombay and killed around 250 and wounded somany .He escaped from India along with a girl friend with fake passport and tried to lead a joyful life in portugal.Portugese govt . after a legal battle handed over him to India. After a long period spending a huge amount he is produced in a tada court with precondition that he should never be given a capital punishment. The Portuguese whose ancesters has butchered in inquisition in Goa has no reason to say a terrorist should not be given a capital punishment. The TADA court will act as per provisions of Indian Law and then only we can say the law of the land is in prevail.

A promise is a promise

I don't disagree that Abu Salem deserves to be punished to the

maximum extent of the law. While I am unaware of how many

extraditions the govt. does every year, but there are plenty of wanted

criminals we need to bring back from foreign lands. That is only

going to happen if we are able to honour the word we have given the

intl. community, so that we can do justice to those people.

If we don't keep our word, other countries may not be in favour of

returning our fugitive nationals back to us. That of course, just brings

us back to the issue of those criminals doing their business from

outside our borders, which leads us absolutely nowhere.

Issuing the death penalty would be a short-sighted thing to do.

I don\\\'t agree with your mindset. Whereas I can see where you are coming from. In reality all creatures that punish must be punished. Abu, babu, dadu whatever Salem, has done crimes against other humans must be punished or else we will have another hijacking wherein we have to free him as well in addition to Mulana masood Azar.Criminals don\\\'t belong to be treated with dignity that they deprived others of.
