The actual cluprits are the Politicians in Power,these rouges have made a dream of having a home miserable, especially after this cong and so called communists in the helm of affairs things have gove from bad to worse.
Cong gave a slogan "Hamara Haath Aam Admi ke Saath " so true they have definetly given "Aam" (Mangoe) to the comman people that too sada huva Aam.

There has to be fast redressal procedure as well as punitive actions against the cheating.... without going through lengthy Cpouts procedures which more annoyoing than Builders cheating....!!!!
Consumer Courts are faster but it has very limited powers...!!!

The article is good, but it's not practical. How many people can actually fight builders?
There was a joke in a movie "When a crime occurs in Japan, their police know about it in 2 hours. In USA, the police take 6 hours to know about the incident. Whereas in India, police know 24 hours before the crime has occured."
The summary, everyone knows what's happening? Unless the legal system gets strong and quick in delivering justice, these things will happen.
The CGSI or the BMC should make standard format agreement. This will avoid builders the chance of fooling the public to a great extent. The builder/firm should be regd and the fotos of the Builders should be fixed.A non-compliant builder may not be allowed to construct another project. Prima facie cases of cheating,hiking of rates,increase in other charges, etc., should be summarily tried and punished by the CGSI/BMC. Payments of 25% should be made only after 6 months of possession. The conveyance, regn,society formation,etc., should be completed within these 6 months. These steps would to a great extent help the buyers.

I had booked a flat in April'06 in Mumbai with RNA Builder(NG) who had promised to deliver the possession of the same by November'06 end but then getting extended and till date there is not yet any confirmation date. This is my first flat booked. As per their statement, I had paid the enitre amount by taking House loan from ICICI Bank. I feel that I have been cheated by RNA Builder(NG) & ICICI Bank both. When Mr. Deep Arora, VP(mktg) was contacted for a reply he told me it may go to JULY /August'07. Can you punish the builder by black listing and will have dare to cheat the common people by both the builder & bank for paying them the full amount? To me its a crime and punishment should be as the criminals get due to their crimes related to cheating & forgery. Due to delay in payment charged at the rate of 21% but at thier fault why the reverse can not be done? ICICI Bnak had sent some goondas to recover the money ? Can you suggest why CEO like Kamat are moving free in this society?
Have you ever checked force majeure clause in the buyer's agreement? Do not sign buyer's agreement without checking it.Here two ,three points are required to be checked carefully.I have seen one of the buyer's agreement where shortage of materials like cement and steel and non availibility of labours have been put in buyer's agreement as force majeure.
Do you think, builder will show you every detail that you have asked for. I live in hyderbad, and the builder attitude is so far like this "Who cares, if not you there is another bakra waiting to be sacrificed". I feel as long there is demand for these apartments, the builders will always remain insensitive to our voices. Even if we go to courts and win, what we get in return is peanuts. Really peanuts. Because, pace at which real estate is growing, do you think, one will be able to afford what he could have afforded to have five years ago. I feel that, the system has to change, judgment should be fast, and relevant to present socio economic status. Anyway, thanks for the article, now i have to get the clearance certificate for my flat.
One has to beaware even of Govt agencies like CIDCO, MHADA . Many belive govt agencies do not cheat but in case of Congress Governed Capitalist Mahrashtra Govt agencies like CIDCO educate and guide private builders of method of how to cheat . In case of any problems common man will end up in lengthy court cases.Today Situation is Total absence of goverment machinery and regulations which takes to task unscrupulous agencies like CIDCO, Rampant cheating by CIDCO by short changing buyers by giving lower carpet area and charging on super built up areas. No standardisation regulations made by the goverment.

The station complexes Built By CIDCO at Nerul , Vashi, CBD. The commercial shops /offices was sold in the open market in 1996-1998 as Saleable Area = Carpet area ( 95-150 ) % loading at higher rates. In the year 2004 The unsold shops / officeswere sold as Saleable Area = Carpet Area ( 30% ) Loading to friends / relatives and front men in the Mktg dept of CIDCO at a discounted price .i e One Bldg , Two Adjacent Shops - Same Carpet Area , But Saleable Area sold differs by 60 % - 120 %. Simple case of Con / Cheating the common man.In case of CIDCO standard measurements do not apply to thier architects. .
