India should introduce background checks of highly-skilled immigrant workers to stop illegal consultancy. Some of the Guys getting H1B but they are working as cleaner or waiter in some place.

no dude.. India cannot do that.. The only way to do that is hike the H1B fees and do the baground check with hiked money..
Can this be done guys.. all these ppl that come to US even without a job should be thrown out and the company that sponsored shd be derecognized and the owners arrested..
I know this is possible. i hv seen this happen to a Desi consultancy in NJ.. Does anybody know how to complain and whom to complain.. the US consulate in India is good for nothing. They screw the legitimate applicants while they let these fake ppl go pretty easy..something has to be done.. no point in honest ppl losing their jobs to such fake ppl..

Inform associations like Programmersguild.org which are fighting against H1B visa fraud in US.
Some of the students going US for higher study really facing problem because of those indians which paying money to these fake agency to block H1B. Any agency or company must declare listing with trade or at least there should be license system to stop growing fake agency. There should be regular check by Indian and US govt to control these mushroom consultants.
There are many students with Master's degree or PHD degrees from other than computer fields. The majority of the consultants belongs to Computer Fields. Because of the shoddy computer companies and consultants, the real talents within the US (Indian students) are not able to secure H1-B visa. And they are under tremendous pressure of leaving USA without finding Jobs. The students or people without talents or higher degree from other countries are most benefited due to H1-B laws. And genuine persons suffer the most. We as a community needs to find a solution to lash out on the fake companies and jobs which work as middle men and loot the money from people in India and USA.

Very true, Is there a website which states the fraud or "black-listed" companies?These are the companies to watch-out for.I know its not a fool-proof solution but atleast gives some pointers on consultancies one can avoid/reject. It would be great help.Thanks

Gone are those days dude.... all the rich kids are now able to get a enginering degree and come to US lots n lots of not so talented guys come to US and after 2 years of MS they cant even compete with a guy who attended 6 months course in a local computer institute..

Students going to the US, dont you tell me you guys are superior than a 3 year experienced guy from india. Students are just taking a different path to the USA. There are so many universities in the US who offer a seat for any graduates (i mean any, he can even be a guy who finished his degree in 6 years) just for the fees they get. Two years study and end with a job in the USA. You guys are paying the universities and people here are paying the consultants. thats all is the difference. http://timeforblog.blogspot.com/

I agree with the two of you above. Many US universities, even some reputed universities, give admission to unqualified applicants simply because they are rich and are able to pay the fees. And these "shady" students have trouble in surviving the tough academics of US universities, but succeed in creating trouble for genuine students. Those who somehow survive again "pay" consultants to get jobs, further increasing competition for the genuine students. Ultimately, it is the genuine student who suffers.

If the job is outsourced to India, then billing rate would be in between 20 and 30$ per hour. If the Job is onsite, then the billing rate for a desi company like Infy, Wipro, Satyam etc...would be 55 to 75$. Only American consultancies like deloitte, PWD etc...ask for 80 to 125$
merit is encouraged in america instead of mediocrity.
anyone with merit will always succeed in america, there is no need to pull strings, pay a bribe, know a minister or have an uncle in an powerful position.
america is top in education (70% world top universities), business (300 largest corporations), science (270 nobel prizes in science), sports (2400 olympic medals)......because MERIT is given the greatest importance.
no need to try russia or china because its impossible, but all with merit are welcome in america.

Thats True. Merit plays a good role. In India, very sad to say all quota and ur birth. Just if the H1B and all emmigration from India goes on like this for another 10 years, imagine who will be there in India to work. These f..in politicians will all die and go and let the rest of the people suffer.
The concept of shortage of Qualified employee is a myth. The Companies simply don't want to pay competitive salaries. The only qualified employees which is Companies fight are over PhD or Highly talented students which are in shortage and hence the concept of H1. But remeber ALL COMPANIES INCLUDING GORA US AND INIDAN US companies. They all exploit 'Cos of the nature of a Consulting market. Softeware vendors keep on inventing technology. So naturally the industry does not have qualified consultants in the latest software. So training an existing consultant is only an option. But unfortunately the Client wants experienced consultants and hence faking of the resume becomes natural... Even the students from US colleges cannot get a job and have to go through the same route.
So in short the act of hiring a consultant TEMPORARILY for a project in latest software will always give rise to UNETHICAL practice.. REMEMBER ALWAYS.. Couple of years ago KPMG (A large US gov. contractor) was never known for SAP implementations. SO THEY USE THEY USED THE SAME TECHNIQUE AS THESE INDIAN COMPANIES... So grow up and avoid the BAD APPLES. Consider your GC as an investment and treat it like a Business Expense. Treat your US company as a partner.. Remeber it near impossible to get a job by your own and you need these middle men for the simple fact that the client insist that and does not want to deal with the finsing/verification of the consultants...
You are all complaining with gunine or false reasons. But none of you are suggesting what should be done.. When U do that then U will find why this is happening...

Go and read some US paper. Hyderabad consulate in picture because most of the fake and fraud registered by FBI and USCIS from Hyderabad. Also most of the MNCs and IT companies started NC to identify the fraud candidate. USICS already blocked some of the activity till OCT. US Govt should issue VISA after NBC (Negative Background check)
