Preventive arrests are misused very often. These must be made justiciable. Courts must examine whether the preventive detention was indeed warranted. In case, it was found by the courts that such preventive arrests were unwarranted or were done with illegal motives, the concerned officials (not the constables who carry out the orders) must be penalized. Public apologies must be published by the concerned governments in at least one national newspaper and another local newspaper which is circulated in the area where such preventive arrests were made.
