Convicted MP's

Can some one tell me how convicted criminals can still be MP's. Should they be disqualified?

They are moved to higher court I guess and case still open. So until they are convicted finally - can't be disqualified. I am just guessing that may be the case....

Because they are convicted by lower courts and they have appealed to higher court.
