Could someone clarify

Although I wish very much the nuclear deal goes through for the best interests of India, I don't understand why the deal has to first go through IAEA and NSG, and the lastly to be voted by the US Congress. Is the US Congress above the IAEA?

Friend, Please see the contentious issues in the Hyde act
1. No freedom to handle spent fuel.
2. No guarantee for alternate fuel supply
3. India is not a technology developer but a recepient.
4. India to side with US in NPT
5. India to participate with US National Security Administration for NPT.
6. Reporting of US President on the efforts of India in containing IRAN.
7. India denied space related dual use technology
8. India denied strategic planning of nuclear programms.
9. Stopped India in the production of fissile materials.
10.No joint move for universal nuclear disarmament.
11.All future agreeents are to be in consistent with this act.
Hyde act is the enabling act for the 123 agreement.

Leaders declare that all these are wrong but failed to arrange a debate in Parliament.
LEFT and BJP failed in the parliament to expose the omissions

Is it not surrendering our freedom and sovereignty?

India is not a NPT state ie. a state that has not signed the Nuclear Non-Proliferation Treaty.
The Indo-US Nuclear deal is about the nuclear fuel and reactor transfer from US to India. Since India is not a signatory to NPT, the US Atomic Energy Act, 1954 stipulate a mandatory deal with IAEA and also with the NSG.
The US Congress is voting the Indo-US Nuke deal. Once India sign the treaty with IAEA and NSG there is no problem in getting fuel from other countries.
After getting the IAEA deal through and get the NSG countries to agree to give us the fuel, then we can even ignore US.

from what i read sometime back, no we dont have to worry about US congress. we should worry only about IAEA and NSG. once they approve it, we can get fuel from other countries like russia/france. but if we have to get fuel from US then US congress will have to pass it.

That is correct. Once NSG approves it, on what grounds can a US President stop other countries from reaching similar agreements as US 123 with India.

US CONGRESS is not above IAEA or NSG. It is similar to Indian Parliament. Today there is an internal US Law that does not allow a US President to sign an Agreement of this nature, it is called HYDE ACT.

123 Agreement stipulates that before it comes into affect, both countries will have to ratify it. India is a parliamentary system and thus does not require any ratification since ruling party has to have a majority. However, US Congress has to ratify it and to do so it will have to amend its own Hyde Act to allow US President to reach an Agreement with India by making it an exception.
