Knickerwallahs, Read 1-2-3 Agreement Before Commenting
A. If the Agreement works in detriment to India we can Terminate under Article 14
1. Either Party shall have the right to terminate this Agreement prior to its expiration on one year's written notice to the other Party. A Party giving notice of termination shall provide the reasons for seeking such termination. The Agreement shall terminate one year from the date of the written notice, unless the notice has been withdrawn by the providing Party in writing prior to the date of termination.
B. If the Hyde Act is seriously implemented by the US, we can pass our own laws to neutralize the Hyde Act- Article 2
1. The Parties shall cooperate in the use of nuclear energy for peaceful purposes in accordance with the provisions of this Agreement. Each Party shall implement this Agreement in accordance with its respective applicable treaties, national laws, regulations, and license requirements concerning the use of nuclear energy for peaceful purpose
It is to remembered that the deal is only nuclear civilian cooperation.
The US will provide us technological transfers and uranium supplies to reactors for civilian purpose - for this they seek guarantees that enriched uranium will not be diverted for militrary purpose.
What we do with our own or other friendly countries (like Russia) technology or uranium is outside the purview of the Deal

Knickerwallahs point out that 1-2-3 Agreement is over-ridden by the Hyde Act. For one thing, an international treaty over-rides national laws. Even for argument sake the reverse holds true, what does the 1-2-3 Agreement say:
Article 2, Para 1 of the 123 agreement text released on August 3, 2007 clearly states:
"The Parties shall cooperate in the use of nuclear energy for peaceful purposes in accordance with the provisions of this Agreement. Each Party shall implement this Agreement "in accordance with its respective applicable treaties, national laws," regulations, and license requirements concerning the use of nuclear energy for peaceful purposes."
So there is no mention of Hyde Act specifically. Only indirectly through "national laws". But this mention of "national laws" is mutual. This means if Hyde Act is a domestic law of the US, we can have a law exactly reverse of the Hyde Act. In a dispute, we are bound by our national laws while the US is to theirs creating a gridlock.
So the argument of Hyde Act is only a bogey used by commies and Knickerwallahs to confuse the public
Of our 22 reactors, 14 will be placed under IAEA supervision, and 8 can be used for military puposes. but more importantly India has retained the right to develop future breeder reactors for its military program. This is a major concession as it means that Russia can build a few more reactors for us and these will not be monitored.

What you have written is all good but you have also missed one crucial point. Once the US Congress ratifies this agreement then Hyde Act is automatically superceded. President Bush may have to answer questions during ratification.

HI Alright,
I was looking for such writeup which expalains the nuances of the N-Deal.. Thanks.. How come this rediff or News channels dont carry such news they r busy with Arushi murder sensation and khali mania.
Coming back to the point..
1) Will the power generated solve the power defficiancy of the country 2) Still we depend on N-fuel uranium, whats the guarantee they wont hike rates.. in turn costly n-power 3) what the guarantee that the supply will be steady for no of years to come.

1. No it will not solve our power problem per se but will mitigate it to some extent. Even factoring the deal, nuclear power is estimated to constitute 6% (an increase of 100%) by 2020 Our nuclear security strategy depends upon a basket of diversified options - gas, oil, wing, solar, bio-fuels etc. This helps us to avoid risks putting all the eggs in one basket. The real advantage is that India has already invested in uranium based reactors, now operating below 50% for want of spares & fuels. So without further investments we can get additional power from existing investment by upping capacity utilization 2. There is no guarantee. As any commodity it is subject to inflation. As you know after oil, the world is going to shortly experience a gas price spikes as never seen before. But the 8 reactors outside the deal and any future reactor we set up outside US assistance can reprocess the spent fuel. Which means we can recycle the uranium. Besides the thorium based reactors first convert it to uranium before using it as fuel. 3. No guarantee as in life. We need to take one day ayt a time
