In government no affidavit can be filed in the Supreme Court before vetting by the law officers (Addl. Solicitor General), who in turn takes the approval of Solicitor General in all sensitive and important cases. These Addl. Solicitor Generals and Solicitor General are political appointees and they leave office when the govt. loses majority or when its term is over. In fact, the affidavit is drafted by these law officers themselves by perusing the records without asking anything from the officers concerned. In any case, govt. officers are not legal experts so they are not supposed to draft the affidavits themselves. The draft is again perused by the seniormost officer of the Department which in this case must be an IAS officer (In today's scenario there is no person more politicised than IAS officers). It is impossible to believe that all of them missed this crucial part of the affidavit. These hapless officials cannot be involved beyond a point as all decisions are taken by higher authorities and ministers in such sensitive cases. Of course, the file moves from these petty officials, so the record will always show their involvement. Thus, it is impossible to believe that UPA was not party to the contents mentioned in the affidavit.
