No doubt this judgement is to be welcomed by all since it puts red flag on all those deeds of the legislature which do not adher to basic structure of the constitution. Be that as it may , now the question is that the supreme court will itself decide what are the basic features of the constitution since these have not been finally put on paper. One court may think at one point in time one issue being essentially a basic feature of the constitution while the other court may not think so on the same issue. Indra has raised a valid point in her article that since our judiciary is a nominated one it has become the final arbiter of various issues being basic features of the constitution or not.In all fairness, it may not be fully in tune with the progressive democratic aspirations of the nation as basic features of the constitution then must also be specifically defined.
