BJP cashing in on CD controversy

BJP so far, since late eighties, could get away with its patently communal politics (causing Babri Masjid demolition and great loss of life & properties to thousands of innocent Muslims) as no F.I.R. was lodged on behalf / at the instance of any State Authority. But this time this FIR in U.P. has been lodged on the instructions of ECI, a Constitutional Authority of India.

But secularists will have to be on guard as given below against baseless defense being advanced in media by BJP:-

(1)- BJP says that because other political parties & their leaders were not booked in recent past for electoral corrupt practices & offenses hence these accused office bearers of BJP should also be spared. This is legally an absurd & ridiculous argument. Moreover BJP should have complained to ECI (as other political parties complained to ECI against BJP on April, 4) against so called offenders of other political parties, if BJP believes that they committed similar offenses.

(2)- BJP says that its National President should not have been booked for the offence committed by its State leaders. But BJP aught to know that mentioning a person as accused in F.I.R. does not mean that he is guilty. It is mentioned in such cases because as per criminal law of India, crime is committed by not only acts of commission but also by acts of omission. This is a matter of evidence and can be ascertained during trial only. Moreover when Warren Anderson, the Chairman of Union Carbide could be booked in India (and prosecution pursued even by the then Government of BJP in the State of Madhya Pradesh) for an offence of his acts of omission in Bhopal gas tragedy then there is no reason why National President of BJP can not be booked for his alleged acts of omission.

(3)- On Monday Lucknow Police did not arrest Rajnath Singh etc (by taking an excuse of so far not having evidence against them) for the simple reason that they wanted to avoid unnecessary disturbance due to presence of large number of BJP workers which Rajnath Singh etc. brought precisely for this purpose and also to score a political point. But now they can be arrested any day by police in near future. BJP aught to know that so far even producer of CD & his team also have not been arrested (though they are certainly guilty of cognizable, non %u2013 bailable offence, whether CD is got produced by BJP or not)

If the producer of the CD was not arrested, how is the police planting stories in the press, that the producers have "confessed" to BJP cultural cell leader being involved ?? So what is the EC going to do ?? He He Ban the BJP. Let them try.
