Republic and democracy
by Manoj on Apr 08, 2007 07:14 PM   Permalink | Hide replies

I think many people do not understand as to what a democratic republic really is. It's not just rule of the majority. If that's the case it would just be a mobocracy.

In a republic there are certain inalienable God given rights that are guaranteed protection. Nobody can infringe on these ever. Thus every new law is subject to the test as to whether it goes against the fundamental rights of the individual or not. Hence it is the right of the judiciary that every law is subject to judicial review and no law or amendment to the Constitution can be brought in that violates the fundamental principles enshrined and guaranteed by the Constitution itself. Nobody can overturn fundamental priciples of justice, not even by majority opinion.

Ram Mandir, Gujarat riots - mobocracy - one caste specially wanted with mob power... not democratic way...

Reservation Issue - democracy - majority (which dont have access to TV, Media, Internet) is seeking justice here...

come one - dont talk about justice... you lost moral ground to talk about justice..

We're talking about whether the Judiciary can oppose the executive bringing in laws that are fundamentally unjust or not. It can and it should; that's all that I'm saying.

Mr.CYBA ETC...the which majority among the creamy layer OBC people dont have access to TV,media and internet??
There is no justification for providing reservation for the creamy layer and rich people..
reservation is to be provided only to the poor and needy irrespective of caste and creed..
dont sound biased but sound little realistic and true..dont make up things and write them...

dude u r talking abt poor......there is a diference b/w rich and poor i guess....

hope u relise tht even in OBC's there r rich OBC's who come under the creamy layer and poor OBC's come under non creamy..if the government was really interested in upliftment of the so called poor obc's then they wud have not proposed reservations to creamy layer obc's...dont get fooled..u have brains..use it...acc to the government proposed resrvations, the rich obc's will avail the reservations and poor obc's will remain poorer...and those 100 workers will remain in the same state...
thts wat im saying from such a long time..just tht u din wanna understand...
