I think the loop hole lies in the law itself. When ever there is either a death or grevious injury by a drunken driver the case is always registered under culpable homicide and not as murder/attempt to murder treating drunken driving on par with negligent driving. If I am not mistaken, in the US, the driver is charged with murder if it is established that he was driving under influence when he caused injury/death. That is why in our country, the erring driver is invariably out on bail since the case is treated as homicide which is bailable. Also, even if it is homicide the punishment is stringent in US i.e. min 20 years in prison where as in our country the fellow will be eligible for parole after 2 years. The law needs to be changed immediately.
