The verdict is necessary because this will create a situation when all wings of Indian democracy will begin acting in tandem. It is mess at the moment. Why did executive signed on the undertaking without consulting judiciary? The answer has two parts, first one is structural in nature in the sense that executive does not reports to judiciary and second one is systemic process. Judicial rationality would have made extradition impossible. And it is fair to assume that giving death penalty was not at the back of the mind of executive. I presume that the motive was to deconstruct the structure of the Bombay Blast and beyond that, to get to the foundation of underworld architecture. What will state of India and Indian socity will acheive by killing( read by executing death penalty) one person ? It is more important to know the processes and network of underworld crime. That will help a common man and society to feel free and consequentially get empowered. But then executive have to have honest in its approach. It should be not such that this acts as alibi for complacency which we often see emperically, hardcore criminals escape during undertrail.
