Service bonds are illegal
by Shiv Kumar on May 01, 2008 10:55 AM   Permalink | Hide replies

The girl could have easily sent a complaint by registered post to the Labour Commissioner of the state she is employed in with a copy to the HR Manager of her employer. That should have done the trick.

Service bonds to retain an employee are illegal under Indian law unless the employer can prove in court that the equivalent of the bond was spent in training the employee or in sending the employee abroad.

So a legal notice would have done the trick.

The girl could also have given a letter to the company saying that the working hours are very high and unless these r reduced, she will leave the company without paying any bond money. Or she should hv consulted some lawyer.

The girl is not a labour, she is an Executive in that firm. There is a solution for this, you have to bring union in this field especially a communist trade union only can do something against this kind of action from an employer.
