Drunk driving: What's wrong with India's youth?

1. The law should treat these cases just like te cases of INTENTIONAL MURDER and then continue with the proceedings.



2. Make provisions to treat these cases under NON-BAILABLE cases.



3. If found guilty should not be hesitent to declare CAPITAL PUNISHMENT.

Law point: I think, these kind of ofences also comes under IPC 302b culpable homicide. And there are instances were punishments upto 10 years were given.



Eliminate at the root: I believe, the road accidents happen mainly because people don't know the safe way to drive. Just driving a vehicle is not quite enough for one to become a driver... he/she should learn the good and safe behaviour on road as well; need to consider fellow citizens on road. For that, the entire licensing system need to be upgraded to meet todays' traffic scenario. Along with making driver understand the good road behaviour, strict enforcing also need to be in place.

You are right; In US any death casued by a drunken driver is termed as man slaughter and is punishable with Jail sentences up to 40 to 50 years. In India the punishment runs concurrently ie in case of death due to negligent driving there are multiple affences including driving under influence, culpable homicide due to negligent driving, intentionally injuring a person etc and punishment for separate wrong doings run simultaneously totalling the jail term to less than 10 years. But in US all the jail terms for separate affences run separately totalling the jail term to more than 25 years. These changes should be immediately incorporated in our legal system to put the fear of god into the minds of youth. Also, the families of victims should be allowed to sue the affenders which is not the case at present.
