Order ,Order ,Part I
by Jehan Mir on May 12, 2008 12:08 AM

Even though politicians, lawyers and professionals emphathize with the unfortunate fate of the retired Supreme Court justices, there appears to be certain legal hurdles,a term which the honorable justices are already too familiar with on their road to restoration .

First,as I understand some or all of the retired justices with the exception of Honorable Chaudhry Iftikhar Sahib were offered the jobs by the previous Government, but on certain political grounds refused to accept the offers of restoration or reappointments, thus waiving for good any claims to such positions.

Second, whether right or wrong, the Supreme Court was discharged by a Presidential decree.
In order to overturn a sitting President's order, the legislators would require a 2/3 majority decision like over-riding any other presidential veto which appears to be wanting.

Thirdly, the retired Supreme Court justices having gone through such a rough political grind can hardly be expected to deliver untainted judgments,if restored.

Finaly, the legislators have no authority, tenability or legal grounds to discharge the present Supreme Court.

What can probably be considered is as a symbolic gesture is to appoint the retired Supreme Court Judges as additional or emeritus Supreme Court judges to handle any Supreme Court's calendar overflow.
