Sub: - Kashmiris aught to utilize this opportunity in the interest of their human rights.

Ref: -

A) - March 28, 2007 seminar on Kashmir in Georgetown University, USA

B) - EUROPEAN PARLIAMENT (2004-09) REVISED COMPROMISE AMENDMENTS, PE 382.592/COMPS 1-30 of March 13, 2007.

Dear Sir

In the run up to this USA seminar arranged by Foreign Lawyers Association (in which as speakers - Kashmiri leaders from both sides of LOC, representative of UN, academicians & NGO from USA, the Ambassadors of India, Pakistan China, UK, Bangladesh, Sri Lanka, are also participating), the EU has shed its crocodile tears on the human rights of Kashmiris of both sides of LOC, where (in this revised compromise amendments) the EU believes that composite dialogue between India and Pakistan (which is nothing but procrastinating techniques of India & Pakistan) will be able to solve Kashmir problem especially in the backdrop of impotent & worthless advisory capacity of UN.

Kashmir problem can be solved neither by military solution nor by these dialogues (which has brought no good to Kashmiris except some futile media coverage to participating Kashmiri leaders) but only through political solution for which Kashmiris aught to realize that:-

(1)- Human right is neither an internal matter of any country nor a bilateral issue between two contending countries but it is basically an obligation of international community, through UN.

(2)- In a senseless armed struggle (supported mainly by fundamentalists on both sides of LOC) the Kasmiris not only have already lost tens of thousands of their youth and have procured grave colossal miseries for Kashmiris on both sides of LOC but surviving Kashmiris owe it to these departed souls that Kashmir problem is solved.

(3)- Kashmir problem can not be solved unless Kashmir is reunified. But on one side Hindu majority India is simply not interested in retrieving its lost territory of Muslim majority POK and on other side India will never compromise on its territorial integrity which implies that whole of J&K (including POK is an integral part of India). Whereas Pakistan does not have adequate military power to snatch remaining Kashmir from India.

(4)- India was partitioned on communal lines in 1947 because there was no genuinely secular political party leading the independence struggle. But the last word is yet to be written on India's partition.

(5)- There has never been better times in India for secular forces especially in view of the down trodden castes of Hindu order & predominant majority of Muslims being left out of India's recent hyped economical progress (as is evident from their mass poverty and the dismal condition of National Rural Employment Guarantee Program).

(6)- In view of political troubles also in Sri Lanka, Bangladesh & Nepal and political uncertainties of Pakistan, the secular Kashmiris from both sides of LOC (in tandem with the secular forces of India, Pakistan, Sri Lanka, Bangladesh & Nepal), may take the initiative and lead for the formation of Federation of Democratic Secular SAARC countries.

(7)- This federation may be on principle where centre deals merely with foreign affairs, currency, defense, citizenship, elections, comptrolling & auditing of Government accounts, communication, nationalized air / water / land routes, employment guarantee programs & human rights while leaving all other matters (including natural resources) to the member States.

(8)- People all over the world including Kashmiris have no future regarding human rights unless UN makes, Optional Protocol to International Covenants on Human Rights with UN, compulsory, which entitles an individual to move UN against human rights violation by Member State.

Hence Kashmiri leaders from both sides of LOC aught to not only remind EU but to also press for it in the coming seminar of March 28, 2007, going to be held in USA -

(i)- About the necessity of Federation of Democratic Secular SAARC countries for the effective solution of also Kashmir problem.

(ii)- About making Optional Protocol to International Covenants on Human Rights with UN, compulsory for all member States (including India and Pakistan).

In this March 28 seminar, Kashmiri leaders and all those who care for the human rights of Kashmiris aught to remind USA that UN being on its soil, USA aught to be more serious about enforcement of human rights of entire mankind and especially of Kashmiris who have already suffered a lot unnecessarily mainly due to :-

(A)- Confusion created by India by participating in the UN proceedings of plebiscite despite constitutional mandate of sovereignty which debars Government of India from taking part in such UN proceedings in view of constitutional provisions of entire J&K including POK as an integral part of India.

(B)- Enactment of Article 370 of the Constitution of India which debilitates the people of J&K by depriving them of the main stream political energy of India.
