sorry state of criminal trials in India
by jawahar lal kaul on Mar 04, 2007 12:57 PM

Abu salems extradition and subsequent trial in the alleged offnces have shakn the foundation of common man's faith in judicial trials. In this case partcularly, when the witnesses, and other evidence may not be easily forthcoming, because of huge lapse of time, the courts must ensure the proper criminal trial in the light of such lapse of time. It is the cardinal principe of criminal justice system, that an offence has to be proved beyond reasonable doubt, particularly, the ones carrying death penality and longer sentences. Secondly, the courts should also lok into the well respected, maxim that justice delayed is justice denied.
