Indian Judicial system is out of control
by Prof R K Gupta-India on Dec 06, 2007 12:07 PM

In name of independence the judiciary has become unaccountable.Thet should not confuse between the two words.Shamelessly the judges defer dates after date.In one case in chandigarh in last 4 years not even one step is taken in file and court shamelessly keeps giving dates(5-6 months)instead of dismissing the case. This is despite amendement of CPC to give only 3 adjournments.
The judges behave in a network like association. If someone complains to high court, they harm the complainant's legal interests.Such judiciary is merely a liability on nation and crime abettor. We should stop calling judiciary honourable and demand action against judges. It is high time ,period limit is fixed for all cases, all cases be scrutinised first by all courts for trial-ability and legal grounds instad of wasting everyone's time. The Indian judiciary is totally out of control. For strange reasons, the judges are not being appointed. No one opposes appointment of more judges and setting up Judicial Commission to hold judges upto high court level accountable. This commission must have very senior and eminent lawyers, social workers and never-being-a-politician as members and must have wide powers to sack a judge, order his or her prosecution/arrest and confiscate property and power to hold particular judgement invalid.Every one knows judges behave arrogantly, simply copy parts of representation filed by lawyer of side in whose favor they write order and make money in bails and acquittals.Situation is bad.
