Japan has expressed concern on India not signing NPT. The reason for that has to do with the arbitrary cut off date in the treaty, since India had formally declared its intent in 1964. Modern Indian state has evolved out of tenuous hold of civil law introduced by few enlightened Britishers. Unlike Japan which had to surrender after its Imperial transgressions and opted to live within the security architecture provided to it; Indian state chose to keep Communism and Neo-Imperialism at bay while also desisting the onslaughts of those aspiring for a theocratic state. The quality and dimensional aspects of Indian legal structure needs to be taken into consideration in judging whether the Indian case merits favourable recognition. Further, on the same valid grounds,since the arbitrary cut off date in NPT is not founded on any sound legal principle; there is a just case for India to be included as a have memember in NPT.
