It is a small thing in comparison to killing and actual rape. Far more henious crimes are committed. They must be warned and possibly jailed for a while. Just because they were thinking doesn't prove that they would be up to commiting. That's where the modus operandi is questionable. With a good lawyer, most of these people should be able to walk away unless they are proved to have commited such acts.
