The court has not done anything against the Hindu Marriage Act, in fact the husband was entitled to get one third of the wife's salary but he has been awarded 7th portion only. When we talk about Gender Equality, I suggest the husband should also be allowed to file suits under Hindu Adoption & Maintenence Act (Section 18) and also he must be given maintenance under section 125 and also under section 23(A). Not only this he must also ask for a proper residence and claim for his share in his wife's parental property. If he feels he has been harassed by his wife and in-laws, he must request the court to arrest all near and far relatives of wife until they prove themselves innocent.
There is no question of unscrupulus husbands taking advantage of such rulings, why would a husband blame his wife if he's not harassed. Well...Decision Makers should continue giving more and more judgements like this and CSR can conduct a study on USAIDs funds after few years whether ther's any misuse or not. I'm sure out of 100 cases only 3 or 4 cases will be of misuse as their report on misuse of IPC 498A states.
