SC upholds conviction of Gill
by J.P.Painuly on Jul 27, 2005 12:38 PM

We need to seriously ponder on the issue- why SC has to hear each and every case in a country where there is such a big backlog of court cases- perhaps going upto 500 years with the present speed of disposal. Why the SC cannot confine to hearing to only issues of importance such as those involving questions of laws. In the past, SC has also heard the cases such as bail of Lalu Yadav, use of stadium by AIADMK (overturning the HC verdict in this case) and other similar cases. Are our HCs not competent enough to give sound verdict even on such small issues? How come same gentlemen elevated to SC can suddenly become competent? So why not have faith in lower courts- at least to HC level for final judgments.

I also do not think it is worth applauding the judiciary for this verdict- coming after 17 years of the incident. Delay is pathetic- common people can not think of getting justice from the judicial system in India in their lifetime. Why can't judiciary and executive put their heads together to resolve this crisis in the judicial system. It is a mystery why stalwarts like Jethmalani and Jaitely failed to address this issue, despite being at the helms for sufficiently long time.
