Indian Judiciary is the best of the three limbs of governance
by Kris iyer on May 27, 2008 09:01 PM  Permalink

The judiciary in India is the best of the three limbs of governance under the Indian Constitution. The Legislature and Executive, in my view, have not done as good a job.
Congress governments had shown neglect in issues like the number of judges, the salary of judges - for many years amongst the lowest in the British Commonwealth of countries, it is, probably so even now. After crucial constitutional cases like Kesavananda Bharathi, Congress governments had shown partiality in appointments to Chief Justiceship. Sound judgments of the apex court have been annulled through constitutional amendments. For example, on reservations and college admissions, the Court has given good advice and suggestions to the government. But Congress having ignored them all, is now faced with the Gujjar agitation. It still messes around with 27% OBC reservation and so on.
Without enough judges, with almost every matter brought to court, not only the usual private and public laws, but also such a lot of PIL (Public Interest Litigation), the high courts and the apex court have done extremely well.

Indian judges are just like other Bearucrate in Revenue department
by sivasubramanian on May 27, 2008 12:21 PM  Permalink  | Hide replies

How does the RI function,First he judges the applicant about his background,If he think the fellow is only has support of himself then every thing gone to that fellow they will charge exorbitent tax than acutually required,
I am asking one question here, how do this RI charge high amount to somebody who don't give them the bribe. They are really most cunning creature in the universe i could say.
Why should a govt employee who is well paid
and always refuses to excute the duty in good sprit. If you go to Municipality for any structural approval if you don't pay the money you will never get approval and your building stand unapproved. Why this court don't understand the corruption and malpractices which causes tremondous trouble to defendent. If you go to Lawer he also try to weaken the situation by presenting weak to the court in alliance with the Officer. So getting justice in INdia is only at the will of the God against the all these adds in Judiciary and Deaprtments.I cite only an example every department has only criminals as officers not like gulf or europe.

come on subramanian, what do you think about indian courts? they are also government servants? when other servants gets their palm greased to get file moved or plan sanctioned, why not grease the judiciary or take care of them (as happened in Mysore last year with a high court judge of Karnataka)your file will get moved fast. Else wait for your grand children to appear on your behalf when the case is heard.
This is indian democracy and judiciary. We have lived for 60 years after independance and we will continue to live for further years without any regrets to the system as we have become immune to these practices.

Request to CJI & OBC reservation judgement is not fair
by srinivasan sathya on May 27, 2008 12:10 PM  Permalink  | Hide replies

I feel OBC reservation judgement is not correct; It could have better advised Govt to comeup with different bill that include poor/middle class uppercaste people into OBC list. Don't allow reservation in PG groups like in Medicine. They break all their brain to get that very smaller number of seats.

Never include rich people/who used Reservation once/ Calculate number of reservation group make it into Open Category list to substract reservation percentage to correct system by itself.

This is the best way moving forward & fair distribution methodlogy.

And to clarify, i am not against Reservation of limited sense directed to needy people. I know it helped people lot & i am happy that u r in well position.

But u need to remember that this is positive discrimination; U know in 30% of TN Open Category is filled by 25% of already Reserved groups. What it indicates that reserved groups are doing well now;

THis TN reservation policy leads clearly to reverse discrimination; Apply reservation formula, when Reserved groups into Open Category is less. If u find this much 25% percentage, U need to transfer Reservation quota to general category.

Pls understand General Category means it is not for uppercaste; We have got enough number of good canidates from all sections. Thatswhy i am saying, Economical/ Educationally backward are important factors

U see 1 brahmin bad; 1 dalit is good; I shall also show different samples. Corrupted official means corrupted one & it requires Administrative reform; it should be broad based policy definition. Best eg EB Office almost occupied by OBC/SC group; After sale deed, if u want to apply name transfer on EB Card, u need/have to pay Rs1500.

So, We should not everything look thro Castiest prism; Mr.LK Advani on Karnataka poll said, Now political parties even afraid of naming CM candidate whatever good he shall be because it will harm voters mindset as he should belong to certain caste & others will not be happy on that. He referred Congress party reluctance to name SM. Krishna as CM candidate.

Caste was there; is there; Will be there depends on Political parties; Those kind of castiest angle is increasing among all people due to Govt/so Official approach.

TN parties should correct this sooner than later.

Annadi court still thrives in India to please govt. agencies.
by on May 27, 2008 11:23 AM  Permalink  | Hide replies

Police are given power to discourage rash driving or motorcycling/prostitution/alchols in bars. Just to show the statistics on records, police catch innocent persons, leaving the real culprits, who are influencial and bribe the police and produce before the courts. The innocent persons are produced before the court and required to spend Rs.5000 to 6000/- as deposit thru lawyers who are also arranged by the police on commission basis. The courts are known as Annadi court (since they dont allow the innocent persons to tell the truth and ask for real evidence). This is spoiling the innocent children and their parents, who are required to spend lot money to lawyers, who are agents of police in most of the local police stations in the country. Can The Supreme Court stop this police menace throught the country and help the innocent children/persons and parents by stopping this kind of police harrassment to fulful the targets/records given by the govt. and other local bodies and boost the income of the State Govt. Even press people are corrupt and publish the colourful stories and encourage the police authorities.

Fool

Look at this fool's answer to the question -
What did the Canadian judges think about Indian anti-terrorist laws?
CJI - "They have great appreciation for the Indian judiciary specially on the question of human rights. Another important thing they like is our environmental laws, and the Supreme Court's intervention in this area. The Supreme Court has repeatedly ruled to protect forests and stop non-forest activities. For any construction or mining activity or even to lay a pipeline in sanctuary areas, the Supreme Court must give clearance." - No relevance or mention to the question asked. No wonder there are 60,000 cases pending before these idiots.

Indian Democracy is a big farce. And the Constitution ? Better not comment on it.The funny part of the Constitution is ' a man in prison (may be a under trial) cannot cast his vote in election but he can contest election and get eleccted and become MLA or MP amd even a minister.

Respected CJI
I request you to decrease the number of holidays for the judges. Are the summer vacations required today also. They may be stopped. The court timings may be changed from 9.30AM to 5.30 pm in all seasons these efforts may add to the productivity of the Judiciary.
