Importer/Exporter can throw some light on this. If the deal is done knowingly and got caught at entry point at India, then both parties should be held responsible and punished by respective governments. To clear this garbage India can sort America's assistance to safely recycle the material. This will also help India to acquire the recycling technology and apply it for its municipal garbage recycling.
