Article-by-article comparison of the 123 agreements signed by China and India clearly indicates greater US trust and a softer approach towards India.
1. Article 2.1 states that each party to the agreement shall implement it in accordance with its national laws. In terms of international law, the provisions of China's 123 agreement are rather intrusive. Article 2.1 states that China may not invoke the provisions of its internal laws to justify violation of the agreement and that Chinese exports pursuant to the agreement will be subject to the US laws that are prevalent at the time of such exports. There is no such provision in the case of the Indian 123 (Article 16.4). It simply states that the agreement will be implemented in good faith and in accordance with the principles of international law.
2.The 123 agreement that China signed has barred the export of nuclear material or technology to China unless the US president certified that China was not assisting a third country that had not signed the Nuclear Non-Proliferation Treaty (NPT) to acquire nuclear weapons technology. This ensured that no transfers would take place till the US administration and Congress were satisfied that China had begun to adhere to international non-proliferation norms. Then President Bill Clinton provided such a certificate to Congress in 1998 and the US Congress approved implementation of the 123 agreement with China shortly after that.

In India's case, both the president and Congress are satisfied that India strictly observes all the operative provisions of the NPT though it is not a signatory to the NPT and no such restrictive provision has been incorporated in the 123 agreement with India.

opposing nuclear deal with US simply due to politics in India rather patriotism.No body comments on the threat from China.They already captured Ladakh and big portion from A.P. and Claiming Sikkim.No this new patriotic Left resonded when chinese army invaded 12 times in A.P. in last three Months and spend some days there.Where was these patriotic left at that time.They were supporting the government?
- coz, u congressmen r selling our nation to the west, in those secret pages.
- coz, u r giving away: 2,000,000,000,000.00 dollars (thats 2KB), from our nation's treasury to the west.
- coz, u r moving our once-proud-and-independent army, scientists and jawans, to become puppets in the hands of the west,
- coz, for the next 250 years, our children will be paying back this `loan-agreement` you are signing, on our behalf!
- coz, india will once again become a slave of the west, like it was for a thousand years b4 '47.
- coz, IAEA's spies (read inspectors) from porkistan, usa, uk, europe, saudi arabia, bangladesh, basically even from the worst banana republic country on earth,
- they can legally enter our innermost-secret-defense-wartime-armed-forces-areas, LEGALLY THEY CAN (AND NO INDIAN CAN STOP `EM),
- and they can LEGALLY check up on ANY PAPER, AND DOCUMENT, AND EQUIPMENT, ANY OFFICER, ANY JAWAN, ANY COMPUTER, ANY ANYTHING!
- coz, our home will become a wasteland, a home we have protected from the invaders from mid-east and the west, for the last millions of years...

US will charm India to take the deal and run the nation on the nuclear energy. The deal with america is always troublesome. we have to find an alternative source to tackle our uranium requirement. Left's stand on deal is appropriate, but they should leave their attitude of always opposing. our country need a huge amount of power and day by day it is increasing. we should spend our time to find a solution for it. There should be an open discussion . I hope everybody will work for it together ...
