Unfortunate Verdict for parents
by Vikas Kr. Sinha on Aug 04, 2008 05:23 PM  Permalink  | Hide replies

What if the child cannot survive a healthy life..! Who will take care of him through out his life? Looks like Court has not taken care of every aspect of this case. Parent should be fully responsible in this exceptional case.

Daily pain for Parents and also the Child
by bavishetty aravind on Aug 04, 2008 05:23 PM  Permalink  | Hide replies

I am not able to really accept the court judgement. I can understand a parents dream about their Child and no parent can really take the pain knowingly that their child would suffer once he comes onto this Earth. At the same time, its not possible for them to substantiate financially. If in the future, the parents fail to meet the expenses is Govt ready to take care throught the life of a child??

Rather than killing the baby lively with his/her hearth problem throughout the Life, its better for the parents to go for abortion.

It is already born man. You cannot just murder it just because it is not as beutiful as you expected or not as intelleginet as you wanted. It is cold blooded murder of a child, when it is in a most defelseless state, not even able to cry.

Obsolecent laws.
by Moses Daniel on Aug 04, 2008 05:22 PM  Permalink

Please check when the law was amended. Those were the time where no facilites available, so to protect the lif of mother they made it. Now we have all facilites to save the life of the mother. Atleast we can avoid the parents from the future sufferings. The politicians and judges can make money to run the show, where will the middle class family go. Please consider. - Moses Daniel

Let it die any natural way but we dont have the right to murder it.

Where does this brutal and inhuman insticts take us ..?

Maye be people start thinking that individulas who are having one or the other handicaps are unfit to be born and to live among us. What pity and inhuman state of mind.

May be one day, the arguement can be extended to intellectual defficiency, appearance, physical streanght and so on ...

How brutal and inhuman for parents to think of killing their infant, even before birth, when they are more helpless, unable to deffend ... not even able to cry.

I am sure, the almighty divine one will curse them and their proponents for generations. Their karma will not be washed away, for a 1000 births, for milleniums.

Dont think you have any sense of what you are talking. Who wants to see a child suffereing, as parents we cannot go thru the pain of the child when he has very high fever, this is about heart, why should any one make life challenging for themselves (as if its not already) and some one who doesnt even know what is going to be there when medically its known, why bring someone to this world when we know its not going to be fair on him.

You may be right at your point Mr. ThinkPad but just imagine..! what if the child grows up with so many health issues. He suffers so many problems everyday (I pray to god, it should not happen to him) How the parents will be able to forgive themselves for giving him a life full of daily death. inch by inch, minute by minute he will face so many problem throughout his life. This will be more harm than good.
As far as 'karma; is concerned, you may say that if we fall ill, its god will because this way he gives us punishment for our sins. With this philosophy you can say that all doctors in world are working against god's rule, which is not true. It's about huminity; not karma.

The law needs to be reviewed by our law makers (MPs & MLAs).
by SV on Aug 04, 2008 05:19 PM  Permalink

The should check the chance of these cases getting detected at later stage of pregnancy to be given abortion at strict clause. That clause should not be used for female feoticide or wrongful purpose it should be ensured.

Not a good decision
by pankaj mittal on Aug 04, 2008 05:19 PM  Permalink  | Hide replies

Court decision doesn't sound good.I feel that parents are the best judge to decide about kids future. If new born baby is not a normal one then who will take the resposnsibility. If court is ready to born the expenses for abnormal kid then a second thought can be given. However in this condition also parents will suffer. Who would like to have abnormal baby? If doctor can assure that new born baby will be anormal one then things are ok.

But again Kudos to Mehta..It will encourage other parents to follow the right track not the illegal way......

This opinion has nothing to do with cruelity..If you think that giving birth to a abnormal baby with prior information is right practice then i really feel sorry about this..... A healthy nation needs healthy children to contribute for future....

hello..if parents are best judge then female infanticide would not exist in india...dont be so naive....the next thing will be are infants perfect, fair etc etc... and in any case the court is there to give judgement, it is the state that has to pass the laws....

Law is not only for Mehtas...it is for the public in general...what the court has said is that "by the law" it cannot rule in favor of Mehtas....and amending laws in India HA HA...anyways i dont support Mehtas on this...ask any childless couple and you will know how deeply they feel..

Bombay HC refuses abortion
by Divakar Hombalgatti on Aug 04, 2008 05:18 PM  Permalink  | Hide replies

This is what we call a pity of the legal system in India. The mother knows what she has to undergo, once she delivers the unhealthy child. Whatever monetary help she would get from anybody,is not a big deal compared to her sacrifice. She doesn't want the child to have a uncertain future once it is born. Our legal system should understand that the pain that the mother and the child undergo cannot be subsidised with any material or sympathy in this world. I strongly condemn the legal system and appreciate the courageous move of the mother not to give birth to a unhealthy child.

Indian Law
by Das on Aug 04, 2008 05:18 PM  Permalink

Its very sad for every one.
I know one family, his daughter is having same heart problem. Dont know how long she will live. Just God's mercy. Her hearts beats are much more less than a common child. Its a pain for that Child as well as the Parents. Cant our law be changed ?
I dont know why she went for law; our law is full of flaw. she could have done other way round...
