SC
by on Apr 02, 2008 03:25 PM  Permalink

The Supreme Court needs to define what it means by 'basic structure' and the people and parliamentarians should work together with the courts to create transparency to the workings and appointments in the judiciary. Unless this is done, we cannot say that our political system is a democratic one.

already verdict given for personal gains by katju & mathur
by sunil sirohi on Dec 13, 2007 10:36 AM  Permalink

now where do people go when goons like ramdoss with no reputation or work for public enact a law to remove a respected and renowned personality like Dr.Venugopal?
it is the legislatures' rights which should be curtailed.
another bet is that after the verdict from katju and mathur, all pending cases will take more time, and more cases will pile up.
no respite for common people, then all will be arming up.this will finally give way to civi war.

by Rabri Yadav on May 12, 2007 01:07 AM  Permalink

People who are concerned should note down the parties who are revolting against the SC verdict, clearly because their manipulatory tool is being taken away!
CAN WE NOT TAKE AWAY THOSE PARTIES' ENTRY RIGHTS TO PARLIAMENT?

Ninth Schedule
by Rajkumar on Apr 08, 2007 06:33 PM  Permalink

Supreme court was originally given by constitution authority to reveiw all laegislations made by legislators. This authority was hijacked by corrupt politicians for their own personal benefits overlooking interests of nation and its people. Now since Supreme court has regained its authority back, politicians are worried and will try to do everything to undermine supreme Courts natural powers given by original makers of constitution. All amendments in the constitution must be endorsed by supreme court.

peoples awareness in the need of the our
by on Jan 26, 2007 09:36 AM  Permalink

when the bill to increase the salary of the MPS both houses of parliament showed total solidarity . the next occassion is the chief ministers meet to discuss the implimentation of SC directions on police reforms . all the chief ministers from nidish kumar to mulayam singh and from buddadev to karunanidhi were vehiment and emotional in opposing the SC directions . they felt no shame favouring an anti-people manual created by Peel to protect their imperialist designs.
As in the case of right to information act , the need of the hour is effective and large scale awareness programmes among the cross sections of the society. rgds sherfudeen

Ninth Schedule: What the Supreme Court means.
by Vaibhav Jain on Jan 19, 2007 08:56 PM  Permalink  | Hide replies

I am a lawyer and as a lawyer I understand the gravity of this action of Supreme Court. But this was very much unfortunate to learn that a lawyer practicing in Supreme Court (Mr. Indira Jaising) would not be able to.

The reason for this judgement of Supreme Court is very simple:

According to Indian Constitution, three wings of the government i.e. Legislature, Executive and Judiciary are free from each other and could not intervene in each other's prerogatives. But parliament (which apparently consist of two wings of government i.e. Legislature and Executive) was persistently curtailing the Supreme Court's power of judicial review, by putting the various laws under Ninth Schedule. So, Supreme Court has done nothing but just reconfirmed the powers originally vested in him by the founding fathers of the Constitution.

Thus, this judgement of Supreme Court is very much correct and will have far reaching results. Coming generation will see (and appreciate) why parliament%u2019s powers are need to be checked.

Ninth Schedule:
by on Jan 17, 2007 09:43 AM  Permalink

If the corrupt polititians don't undo the Jan 11th 2007 judgement on the 9th schedule, it will be no doubt a red letter day in the history of FREE INDIA. Supreme court is Supreme and should have the last say in all the matters related to the constitution.
But, this minority govt. with as many as 24 ministers from Rajya Sabha, who could not win peoples mandate, will now try to do all that they can to buy the judiciary. Now the judiciary should prove itself that they really care for the citizens and their rights.
