Any sexual assault may now fall under rape
by shreyas mishra on Feb 27, 2007 09:00 PM  Permalink

Please give them some more rights so that they need not to work in govt. offices and their hefty pay packets reach their home without doing anything. Already most of them are working for their cosmetic, managing all household and personal work from office, reading magazines and worshiping god in office hours, coming late and going early, availing all benefits and when asked by their boss/colleageue to complete the office work they have now a new weapon in the name of sexual assault. So anybody asking them to work will be their victim. Thanks to Madam Girja Vyas and all other politicians for bringing such new bills.

Forcing helps?

I would say it's all in the mind. It's the mindset that needs to change. Otherwise, both sexes will find loopholes in the law and take advantage of it.
Will this law change the way rural India thinks? If it's scaring the men in rural India is the objective then NCW has got it totally wrong.
I believe that the govt, NCW and hordes of other organisations have failed to change the basic outlook of women in India. If that can be changed then there will be no rapes or sexual assaults.
Our mindset towards women sucks. And ironically we call our country "Mother India".
Yes most men are hypocrites. I know it because it takes a lot to understand the fairer sex to change your mindset.
Laws are for dicipline. It won't change the mindset. It needs to come from the govt and organisations like NCW and the people should support it.
Right now it's just a populist measure.

double standard
by Rajesh on Feb 27, 2007 12:19 PM  Permalink

in some cases womens are also behaving casualy with mens at worklplace or with friends.
if a girl is slapping casualy over back or hip of a man there is no sex assault.
but in the reverse case it's crime.
this is a double standard.
rules should be same both ways.

Any law is good as long as it is taken in the right spirit and not exploited.
Though it is a step in the right direction, there are many who would use it to their benefit.
Remember, the statement alone of the female is taken into account when acting upon such complaints.
The situation is such that nowadays the law is heavily loaded in favor of the female sex.
We can only hope that people dont use it to settle personal scores.

I really don't know why we people believe the policies of the govt. or supreme court so easily.
First all these laws are only applicable for the middle class and lower class, and not applicable for the upper class because the moment somebody will do such a crime and that person belonged to a good family the laws will automatically change or the lawyers would find a flaw in this.

Second, laws are regularly made but I would ask the supreme court what effort has been made in order to give sentence to the people who already are convicted in such casses. nothing right......... so please before making any law first set a good example before public because now India is more literate......

Good proposal. There should be laws against spousal rape too.
by indiantothecore on Feb 27, 2007 02:33 AM  Permalink  | Hide replies

This will reduce Sexual harrassment in the workplace. From actresses to clerks working in small offices, their male bosses and collegues will not get away with sexual advances under the guise of harmless flirting and social interaction, a prerequisite for professional favors and career promotions.

While they are recommending change in laws. There are other sensitive issues as well. Many women are raped by their spouses, they are ashamed and embarrased to discuss it. How about some law against spousal rape and abuse?

Hi indiantothecore,

your recommandation has one strong hardle that is the system of Marriage which is accepted by our society on the basis of Physical relationship betn husband and wife so any law currently in force can not charge spouse being raped. This should their mutual understanding and in case any one is sufferning he/she can satify spouse by other ways also. Lastly they can go for divorced if the he/she cannot bare the situation. By making such a law (recommanded by u) will break the concept of marriage only.

Ketan

yeah it may really help women who are totally dependent on their husbands in rural regions. I don't think a woman wants to have half a dozen kids with a husband who abuses her. But sometimes she has no choice.

Well said!

All abuse, even verbal, should be brought under the scope of this law.

These people treat women like cattle.

Verbal abuse is bad yet it is not equally bad as physical abuse. There are so many anorexic married women in our towns and villages who deliver babies each year, no one bothers to ask them about her married life.
Everyone simply assumes the more babies they have the happier they are together which is a misconception many a times.

If verbal abuse is part of the law physical abuse can be prevented in many cases.

As the practice goes, first the women are humiliated verbally and then these animals move to the physical part.

Verbal abuse law can be a good deterrent.

Any sexual assault may now fall under rape; I change it to Any sexual contact may now fall under rape. What a country we are living in and we are going centuries back..

Soln - NCW can put now a big wall and put women and men each side so that there is no eye contact...

anyway according to statistics we are going to be all male country a few years from now...

Tired... are we heading anywhere...?...

Sexual Assault
by CG NAIR on Feb 26, 2007 05:59 PM  Permalink  | Hide replies

The NCW's demand for treating other kind sexual assaults also as rape is untenable under law. It was reported during last week that a girl stayig in a Mumbai suburb made a false complaint about her newly wed husband of stealing ornaments and throwing her out of train on their way to Goa for honeymoon. The poor guy was behind bars for more than week (also might have got enough trashing from the cops!) and the episode turned out to be a conspiracy hatched by the girl alongwith her former husband and his friend to get rid of him. In another case reported in Mumbai about a week back, a girl had accused her own father of raping and this fellow (a BMC worker) was behind bars for more than two years. I wonder how a girl can accuse her own father of such a henious crime. A large number of cases lodged under section 498-A are also false. In such a senerio, the law makers needs to be careful before enacting such draconian laws.

GOOD PROPOSAL...THIS WILL INSTILL FEAR...
by Baba Kamdev on Feb 26, 2007 05:52 PM  Permalink

AT FIRST THIS RECOMMENDATION MANY SOUND GOING A BIT OVERBOARD....BUT IF THIS IS ENFORCED THEN THIS WILL INSTILL SOME FEAR IN MEN HARRASSING WOMEN....

PLEASE DONT OVERREACT TO ITS POTENTIAL MISUE.FIRST READ THE DEFINITION OF "ASSAULT" AND THEN REACT.HALF KNOWLEDGE IS DANGEROUS.

HERE THE NWC WANTS TO RULE OUT POSSIBILITY SIMILAR TO BILL CLINTON, WHERE HE WAS NOT GUILTY, JUST BECAUSE HE TRIED TO MAKE MONICA SMOKE CIGAR FROM A WRONG ORGAN.

THERE ARE MANY WOMENIN INDIA, WHO ARE HARRASSED BY OWN FRIENDS,RELATIVES,COLLEGUES BUT THEY CANT TAKE ACTION AGAINST THEM JUST BECAUSE PERSON DID NOT COMPLETELY PERFORM THE ACT...BUT EVEN PERFORMING "HALF-ACTS" IS ALSO PSYCHOLOGICALLY TAXING ON THE WOMEN.

PLEASE DO NOT BE WORRIED ABOUT BEING CHARGED FOR ACCIDENTAL FALL OR PUSH ON WOMEN.INDIAN WOMEN ARE NOT THAT UNREASONABLE...SOME EXCEPTION WILL ALWAYS BE THERE, BUT THIS WILL BENEFIT THE MAJORITY OF WOMEN.
